הִלְכוֹת קִדּוּשׁ הַחֹדֶשׁ פֵּרֶק ז
א אֵין קוֹבְעִין לְעוֹלָם רֹאשׁ חֹדֶשׁ תִּשְׁרִי לְפִי חֶשְׁבּוֹן זֶה[1], לֹא בְּאֶחָד בַּשַּׁבָּת, וְלֹא בִּרְבִיעִי בַּשַּׁבָּת, וְלֹא בְּעֶרֶב שַׁבָּת - סִימָן לָהֶם אד"ו; אֵלָא כְּשֶׁיִּהְיֶה מוֹלַד תִּשְׁרִי בְּאֶחָד מִשְּׁלוֹשָׁה יָמִים הָאֵלּוּ, קוֹבְעִין רֹאשׁ הַחֹדֶשׁ בַּיּוֹם שֶׁלְּאַחֲרָיו. כֵּיצַד--הֲרֵי שֶׁהָיָה הַמּוֹלָד בְּאֶחָד בַּשַּׁבָּת, קוֹבְעִין רֹאשׁ חֹדֶשׁ תִּשְׁרִי יוֹם שֵׁנִי; וְאִם יִהְיֶה הַמּוֹלָד בִּרְבִיעִי, קוֹבְעִין רֹאשׁ חֹדֶשׁ בַּחֲמִישִׁי; וְאִם יִהְיֶה הַמּוֹלָד בְּשִׁשִּׁי, קוֹבְעִין רֹאשׁ חֹדֶשׁ בִּשְׁבִיעִי.
ב וְכֵן אִם יִהְיֶה הַמּוֹלָד בַּחֲצִי הַיּוֹם אוֹ לְמַעֲלָה מֵחֲצִי הַיּוֹם[2], קוֹבְעִין רֹאשׁ חֹדֶשׁ בַּיּוֹם שֶׁלְּאַחֲרָיו. כֵּיצַד--הֲרֵי שֶׁהָיָה הַמּוֹלָד בַּיּוֹם הַשֵּׁנִי שֵׁשׁ שָׁעוֹת בַּיּוֹם אוֹ יָתֵר עַל שֵׁשׁ שָׁעוֹת, קוֹבְעִין רֹאשׁ חֹדֶשׁ בַּשְּׁלִישִׁי. וְאִם יִהְיֶה הַמּוֹלָד קֹדֶם חֲצִי הַיּוֹם, אַפִלּוּ בְּחֵלֶק אֶחָד - קוֹבְעִין רֹאשׁ הַחֹדֶשׁ בְּאוֹתוֹ יוֹם הַמּוֹלָד עַצְמוֹ: וְהוּא, שֶׁלֹּא יִהְיֶה אוֹתוֹ הַיּוֹם מִיְּמֵי אד"ו.
ג כְּשֶׁיִּהְיֶה הַמּוֹלָד בַּחֲצוֹת הַיּוֹם אוֹ אַחַר חֲצוֹת, וְיִדָּחֶה[3] לְיוֹם שֶׁלְּאַחֲרָיו - אִם יִהְיֶה הַיּוֹם שֶׁלְּאַחֲרָיו מִיְּמֵי אד"ו -הֲרֵי זֶה נִדְחֶה לְשֶׁלְּאַחַר אַחֲרָיו, וְיִהְיֶה רֹאשׁ הַחֹדֶשׁ קָבוּעַ בַּשְּׁלִישִׁי מִיּוֹם הַמּוֹלָד. כֵּיצַד: הֲרֵי שֶׁהָיָה הַמּוֹלָד בַּשַּׁבָּת בַּחֲצוֹת הַיּוֹם, סִימָן ז' י"ח[4] - קוֹבְעִין רֹאשׁ הַחֹדֶשׁ בַּשָּׁנָה שֶׁמּוֹלָדָהּ כְּזֶה, בְּשֵׁנִי בַּשַּׁבָּת; וְכֵן אִם הָיָה הַמּוֹלָד בַּשְּׁלִישִׁי בַּחֲצוֹת אוֹ אַחַר חֲצוֹת, קוֹבְעִין רֹאשׁ הַחֹדֶשׁ בַּחֲמִישִׁי בַּשַּׁבָּת.
ד מוֹלַד תִּשְׁרִי שֶׁיָּצָא בְּחֶשְׁבּוֹן זֶה בְּלֵיל שְׁלִישִׁי בְּתֵשַׁע שָׁעוֹת בַּלַּיְלָה וּמָאתַיִם וְאַרְבָּעָה חֲלָקִים מִשָּׁעָה עֲשִׂירִית, סִימְנָהּ ג' ט' ר"ד, אוֹ יוֹתֵר עַל זֶה - אִם הָיְתָה שָׁנָה פְּשׁוּטָה, דּוֹחִין אֶת רֹאשׁ הַחֹדֶשׁ, וְאֵין קוֹבְעִים אוֹתוֹ בַּשְּׁלִישִׁי בְּשָׁנָה זוֹ, אֵלָא בַּחֲמִישִׁי בַּשַּׁבָּת.
ה וְכֵן אִם יָצָא מוֹלָד תִּשְׁרִי בְּיוֹם שֵׁנִי בְּשָׁלוֹשׁ שָׁעוֹת בַּיּוֹם וַחֲמֵשׁ מֵאוֹת וּשְׁמוֹנִים וְתִשְׁעָה חֲלָקִים מִשָּׁעָה רְבִיעִית, סִימָנָהּ ב' ט"ו תקפ"ט, אוֹ יָתֵר עַל כֵּן--אִם הָיְתָה אוֹתָהּ הַשָּׁנָה מוֹצָאֵי הַמְּעֻבֶּרֶת, שֶׁתִּהְיֶה הַשָּׁנָה הַסְּמוּכָה לָהּ שֶׁעָבְרָה מְעֻבֶּרֶת--אֵין קוֹבְעִין רֹאשׁ הַחֹדֶשׁ בַּשֵּׁנִי בְּשָׁנָה זוֹ, אֵלָא בַּשְּׁלִישִׁי.
ו הָיָה מוֹלַד הַשָּׁנָה הַפְּשׁוּטָה שֶׁאָמַרְנוּ שֶׁתִּדָּחֶה לַחֲמִישִׁי פָּחוּת חֵלֶק אֶחָד, כְּגוֹן שֶׁיָּצָא סִימָנָהּ ג' ט' ר"ג אוֹ פָּחוּת מִזֶּה--קוֹבְעִין אוֹתָהּ בַּשְּׁלִישִׁי; וְכֵן אִם הָיָה מוֹלַד מוֹצָאֵי הָעִבּוּר פָּחוּת חֵלֶק, כְּגוֹן שֶׁהָיָה סִימָנָהּ ב' ט"ו תקפ"ח אוֹ פָּחוּת מִזֶּה--קוֹבְעִין אוֹתָהּ בַּשֵּׁנִי. נִמְצָא דֶּרֶךְ קְבִיעַת רֹאשׁ חֹדֶשׁ תִּשְׁרִי לְפִי חֶשְׁבּוֹן זֶה, כָּךְ הוּא: תְּחַשַּׁב וְתֵדַע הַמּוֹלָד בְּאֵי זֶה יוֹם יִהְיֶה, וּבְכַמָּה שָׁעוֹת מִן הַיּוֹם אוֹ מִן הַלַּיְלָה, וּבְכַמָּה חֲלָקִים מִן הַשָּׁעָה. וְיוֹם הַמּוֹלָד הוּא יוֹם הַקְּבִיעָה לְעוֹלָם, אֵלָא אִם כֵּן הָיָה בְּאֶחָד בַּשַּׁבָּת אוֹ בִּרְבִיעִי אוֹ בְּעֶרֶב שַׁבָּת, אוֹ אִם הָיָה הַמּוֹלָד בַּחֲצוֹת הַיּוֹם אוֹ אַחַר חֲצוֹת, אוֹ אִם הָיָה בר"ד חֲלָקִים מִשָּׁעָה עֲשִׂירִית מִלֵּיל שְׁלִישִׁי אוֹ יוֹתֵר עַל זֶה וְהָיְתָה שָׁנָה פְּשׁוּטָה, אוֹ שֶׁהָיָה הַמּוֹלָד בתקפ"ט חֲלָקִים מִשָּׁעָה רְבִיעִית מִיּוֹם שֵׁנִי וְהָיְתָה הַשָּׁנָה פְּשׁוּטָה שֶׁאַחַר הַמְּעֻבֶּרֶת--שְׁאִם יֵארַע אֶחָד מֵאַרְבָּעָה דְּבָרִים הָאֵלּוּ, אֵין קוֹבְעִין בְּיוֹם הַמּוֹלָד, אֵלָא בַּיּוֹם שֶׁלְּאַחֲרָיו אוֹ שֶׁלְּאַחַר אַחֲרָיו, כְּדֶרֶךְ שֶׁבֵּאַרְנוּ.
ז וּמִפְּנֵי מַה אֵין קוֹבְעִין בְּחֶשְׁבּוֹן זֶה בִּימֵי אד"ו--לְפִי שֶׁהַחֶשְׁבּוֹן הַזֶּה הוּא לְקִבּוּץ הַיָּרֵחַ וְהַשֶּׁמֶשׁ בְּהִלּוּכָם הָאֶמְצָעִי, לֹא בִּמְקוֹמָם הָאֲמִתִּי, כְּמוֹ שֶׁהוֹדַעְנוּ; לְפִיכָּךְ עָשׂוּ יוֹם קְבִיעָה וְיוֹם דְּחִיָּה, כְּדֵי לִפְגֹעַ בְּיוֹם הַקִּבּוּץ הָאֲמִתִּי. כֵּיצַד--בַּשְּׁלִישִׁי קוֹבְעִין, בָּרְבִיעִי דּוֹחִין, בַּחֲמִישִׁי קוֹבְעִין, בַּשִּׁשִּׁי דּוֹחִין, בַּשַּׁבָּת קוֹבְעִין, בְּאֶחָד בַּשַּׁבָּת דּוֹחִין, בַּשֵּׁנִי קוֹבְעִין.
ח וְעִיקַר שְׁאָר הָאַרְבַּע דְּחִיּוֹת הָאֵלּוּ, הוּא זֶה הָעִיקָר שֶׁאָמַרְנוּ, שֶׁהַחֶשְׁבּוֹן הַזֶּה בְּמַהְלָךְ אֶמְצָעִי; וּרְאָיָה לַדָּבָר, שֶׁהֲרֵי הַמּוֹלָד יִהְיֶה בְּלֵיל שְׁלִישִׁי וְיִדָּחֶה לַחֲמִישִׁי, וּפְעָמִים רַבּוֹת לֹא יֵרָאֶה יָרֵחַ בְּלֵיל חֲמִישִׁי. וְלֹא עוֹד, אֵלָא וְלֹא בְּלֵיל שִׁשִּׁי, מִכְּלָל שֶׁלֹּא נִתְקַבְּצוּ הַשֶּׁמֶשׁ וְהַיָּרֵחַ קִבּוּץ אֲמִתִּי אֵלָא בַּחֲמִישִׁי.
Hilchos Kiddush HaChodesh, Chapter 7
1. We never establish Rosh Chodesh Tishrei according to this calculation on Sunday, Wednesday, or Friday—its sign is ADU. Rather, if the molad of Tishrei falls on one of these three days, we establish Rosh Chodesh on the following day. How so? If the molad is on Sunday, we establish Rosh Chodesh Tishrei on Monday. If the molad is on Wednesday, we establish Rosh Chodesh on Thursday. If the molad is on Friday, we establish Rosh Chodesh on Shabbos.
2. Likewise, if the molad occurs at midday or later, we establish Rosh Chodesh on the following day. How so? If the molad is on Monday at six hours into the day or later, we establish Rosh Chodesh on Tuesday. If the molad is before midday, even by a single part, we establish Rosh Chodesh on the very day of the molad itself—provided that day is not one of the ADU days.
3. When the molad is at midday or after, and it is postponed to the following day, if that following day is one of the ADU days, it is postponed again to the day after that, so that Rosh Chodesh is established on the third day from the molad. How so? If the molad is on Shabbos at midday, sign Zayin Yud Ches, we establish Rosh Chodesh in a year with such a molad on Monday. Similarly, if the molad is on Tuesday at midday or after, we establish Rosh Chodesh on Thursday.
4. If the molad of Tishrei, according to this calculation, falls on Tuesday night at nine hours into the night and two hundred and forty-four parts of the tenth hour—sign Gimmel Tes Reish Daled—or later, and it is a regular year, we postpone Rosh Chodesh and do not establish it on Tuesday that year, but rather on Thursday.
5. Likewise, if the molad of Tishrei falls on Monday at three hours into the day and five hundred and eighty-nine parts of the fourth hour—sign Beis Tes Vav Taf Kuf Pei Tes—or later, and that year follows a leap year, meaning the year immediately after a leap year, we do not establish Rosh Chodesh on Monday that year, but rather on Tuesday.
6. If the molad of the regular year, which we said should be postponed to Thursday, is short by one part, for example, if its sign is Gimmel Tes Reish Gimmel or less, we establish it on Tuesday. Similarly, if the molad after a leap year is short by one part, for example, if its sign is Beis Tes Vav Taf Kuf Pei Ches or less, we establish it on Monday. Thus, the method for establishing Rosh Chodesh Tishrei according to this calculation is as follows: Calculate and determine on which day the molad will occur, at what hour of the day or night, and how many parts of the hour. The day of the molad is always the day of establishment, unless it is Sunday, Wednesday, or Friday, or if the molad is at midday or after, or if it is at Reish Daled parts of the tenth hour of Tuesday night or later and it is a regular year, or if the molad is at Taf Kuf Pei Tes parts of the fourth hour of Monday and it is a regular year following a leap year. If any of these four things occur, we do not establish on the day of the molad, but rather on the following day or the day after, as we have explained.
7. Why do we not establish, according to this calculation, on the ADU days? Because this calculation is for the mean conjunction of the moon and the sun in their average motion, not in their true position, as we have explained. Therefore, they made a day of establishment and a day of postponement, in order to coincide with the true day of conjunction. How so? On Tuesday we establish, on Wednesday we postpone, on Thursday we establish, on Friday we postpone, on Shabbos we establish, on Sunday we postpone, on Monday we establish.
The main point of the other four postponements is this principle that we have stated: that this calculation is based on an average cycle. And the proof for this is that the molad can occur on the night of the third day, and yet it will be postponed to the fifth day, and many times the moon will not be seen on the night of the fifth day. Moreover, it will not even be seen on the night of the sixth day, which shows that the sun and the moon have not truly come together until the fifth day.
