Negative Mitzvah 245 - Not to rob (take by force and openly)

המצווה הרמ"ה

האזהרה שהזהרנו מלגזול, והיא לקיחת דבר שאין לנו זכות בו, באנס ובחזקה בגלוי.

והוא אמרו יתעלה: "לא תגזל" (ויקרא יט, יג). וכך פירשו בעלי הקבלה: "לא תגזל" - כעניין שנאמר: "ויגזל את החנית מיד המצרי" (שמואל-ב כג, כא).

ולאו זה נתק לעשה והוא אמרו: "והשיב את הגזלה אשר גזל" (ויקרא ה, כג) אלא שאפילו ביטל עשה שבה - אינו לוקה, שאין אדם לוקה ומשלם, לפי שהוא לאו שנתן לתשלומין; שאם שרף את הגזלה או זרקה לים - משלם מה שהייתה שווה.

ואם כפר בה ונשבע - מוסיף חמש ומקריב אשם, כמו שנתבאר במקומו, וכן נתבאר בסוף מכות.

The 245th Mitzvah

1. The prohibition in which we were warned against stealing, which is taking something to which we have no right, by force and openly.

2. This is as He, may He be exalted, said: "You shall not steal" (Vayikra 19:13). And so the Sages explained: "You shall not steal"—as in the verse, "and he took the spear from the Egyptian's hand" (Shmuel II 23:21).

3. This prohibition is rectified by a positive commandment, as He said: "and he shall return the stolen item which he stole" (Vayikra 5:23). However, even if one neglects the positive commandment, he does not receive lashes, for a person does not receive lashes and pay at the same time, since this is a prohibition given for restitution; if he burned the stolen item or threw it into the sea, he pays its value.

4. And if he denied it and swore, he adds a fifth and brings a guilt-offering, as explained in its place, and as is also explained at the end of Makkos.
