The Prohibition Against Stealing Property
1. The prohibition in which we were warned not to steal property.
2. This is as He said: "You shall not steal" (Vayikra 19:11).
3. And in the Mechilta: "'You shall not steal'—this is a warning against stealing property."
4. One who transgresses this prohibition is obligated to make restitution as specified in the Torah: either double payment, or fourfold or fivefold payment, or simply returning the principal alone.
5. And in the Sifra: "Since it is stated regarding theft, 'He shall pay double' (Shemos 22:3), we have learned the punishment; from where do we learn the warning? The verse teaches: 'You shall not steal.' [This applies] even if one steals in order to anger the victim and confuse him, and then returns it to him—'You shall not steal' even with the intention of later paying him fourfold or fivefold."
6. The laws of this mitzvah have already been explained in chapter 7 of Bava Kama.
