המצווה הרמ"ו
האזהרה שהזהרנו מלגנוב גבולות הקרקעות.
והוא שלא נשנה את הגבול שבינינו לבין זולתנו עד שיהא אפשר לטוען לטעון [לעצמו] את קרקע זולתו.
והוא אמרו יתעלה: "לא תסיג גבול רעך". (דברים יט, יד) והלא כבר נאמר: "לא תגזל"? ומה תלמוד לומר "לא תסיג"? - מלמד שכל העוקר תחומו של חברו - עובר בשני לאווין.
יכול אף בחוצה לארץ? תלמוד לומר: "נחלתך אשר תנחל בארץ" (דברים יט, יד). בארץ ישראל עובר בשני לאווין, בחוצה לארץ אינו עובר אלא משום לאו אחד, כלומר: "לא תגזל".
הנה נתבאר שלאו זה אינו אלא בארץ ישראל..
The 246th Prohibition
1. The prohibition in which we were warned not to steal the boundaries of land.
2. This means that we must not alter the boundary between ourselves and another person so that it becomes possible for someone to claim another’s land as his own.
3. This is as He, may He be exalted, said: “You shall not move your neighbor’s boundary” (Devarim 19:14). But it is already stated: “You shall not steal”; what then does “You shall not move” teach? It teaches that anyone who removes his fellow’s boundary transgresses two prohibitions.
4. Could this apply even outside of Eretz Yisroel? The verse teaches: “your inheritance which you shall inherit in the land” (Devarim 19:14). In Eretz Yisroel, one transgresses two prohibitions; outside of Eretz Yisroel, one transgresses only one prohibition, namely: “You shall not steal.”
5. Thus, it is clear that this prohibition applies only in Eretz Yisroel.
