המצווה הק"מ
הציווי שנצטווינו לספור את השנים מעת השתלטנו על הארץ והחזקנו בה שבע שבע שנים עד שנת היובל.
ומצווה זו, כלומר: ספירת שני שמטה, היא מסורה לבית דין, כלומר: סנהדרי גדולה, שהם הם שסופרים שנה שנה מחמשים השנים, כדרך שכל אחד ואחד ממנו מונה ימי העמר.
והוא אמרו יתעלה: "וספרת לך שבע שבתת שנים וגו'" (ויקרא כה, ח).
ולשון ספרא:"יכול יספר שבע שמטים זו אחר זו ויעשה יובל? תלמוד לומר: 'שבע שנים שבע פעמים' (ויקרא כה, ח) הא עד שיאמרו שני כתובים; ואם לאו לא שמעינן".
כלומר: מצווה זו לא תושג איכות עשייתה אלא משני כתובים, היינו שנמנה השנים לבדן ונמנה גם השמיטין עמהן".
כיון שאמר, שעניין זה לא יושג אלא משני כתובים, משמע שהיא בהחלט מצווה אחת.
כי אילו היו שתי מצוות, כלומר: מנין שנים ומנין שמטין - לא היה אומר "עד שיאמרו שני כתובין", כי כך משני כתובים נלמדות כל שתי מצוות, וכן כל מצווה ומצווה מכתוב שלה, ולעולם אין אומרים "הא עד שיאמרו שני כתובים" אלא במצווה אחת, שלא נשלמת ידיעת דיניה אלא משני כתובים.
כמו הבכור שאמר בו הכתוב: "כל פטר רחם לי" (שמות לד, יט), כי כתוב זה לבדו מורה שהבכור לה' - בין זכר בין נקבה - ובא כתוב אחר, "הזכרים לה'" (שמות יג, יב); ופסוק זה לבדו מורה, שכל זכר לה' - בין בכור בין פשוט.
אבל משני הכתובים השג עניין המצווה, שהוא בכור זכר בלבד כמו שביארו במכילתא.
The commandment to count the years for Yovel
1. The commandment with which we were commanded to count the years from the time we took possession of the land and established ourselves in it, counting seven by seven years until the year of Yovel.
2. And this commandment, that is, the counting of the Shemitah years, is entrusted to the Beis Din, meaning the Great Sanhedrin, for they are the ones who count each year of the fifty years, just as each one of us counts the days of the Omer.
3. And this is as He, may He be exalted, said: "And you shall count for yourself seven sabbaths of years, etc." (Vayikra 25:8).
4. And the language of the Sifra: "Could it be that one counts seven Shemitahs one after another and makes a Yovel? The verse teaches: 'Seven years, seven times' (Vayikra 25:8)—this teaches that it requires two verses; and if not, we would not have learned it."
5. That is to say, this commandment cannot be properly fulfilled except through two verses: that we count the years alone, and we also count the Shemitahs among them.
6. Since it says that this matter is only attained through two verses, it implies that it is certainly one commandment. For if they were two commandments, that is, the counting of years and the counting of Shemitahs, it would not have said "until two verses are stated," for from two verses we always learn two commandments, and likewise, every commandment is learned from its own verse. And we never say "this is only until two verses are stated" except regarding one commandment, whose laws are not fully known except from two verses.
7. Like the case of the firstborn, where the verse says: "Every first issue of the womb is Mine" (Shemos 34:19), for this verse alone would indicate that the firstborn belongs to Hashem, whether male or female. Then another verse comes: "The males are for Hashem" (Shemos 13:12); and this verse alone would indicate that every male is for Hashem, whether firstborn or not. But from both verses together, you understand the matter of the commandment, that it is only a male firstborn, as explained in the Mechilta.
