Laws of Sanctifying the Month

There is one positive commandment in the laws of sanctifying the month: to calculate, to know, and to establish on which day the beginning of each month of the year falls.

1. The months of the year are lunar months, as it is stated: "The burnt-offering of the month in its month" and it is stated: "This month shall be for you the beginning of months." So said the Sages: The Holy One, blessed be He, showed Moshe in a prophetic vision the form of the moon, and said to him, "Like this, see and sanctify." The years that we calculate are solar years, as it is stated: "Observe the month of spring."

2. The solar year exceeds the lunar year by about eleven days. Therefore, when this excess accumulates to about thirty days, or a little less or a little more, we add one month and make that year thirteen months; this is called a leap year. For it is not possible for the year to be twelve months and such-and-such days, as it is stated: "For the months of the year"—you count months for the year, but you do not count days.

3. The moon is hidden each month and is not seen for about two days, or a little less or a little more: about one day before it joins the sun at the end of the month, and about one day after it joins the sun; and it will be seen in the west in the evening. On the night it is seen in the evening after it was hidden, that is the beginning of the month, and from that day we count twenty-nine days. If the moon is seen on the night of the thirtieth, the thirtieth day will be Rosh Chodesh; if it is not seen, Rosh Chodesh will be on the thirty-first day, and the thirtieth day will belong to the previous month. We do not consider the moon on the thirty-first night, whether it is seen or not, for there is no lunar month longer than thirty days.

4. A month that is twenty-nine days, and the moon is seen on the night of the thirtieth, is called a deficient month. If the moon is not seen, and the previous month is thirty days, it is called a full month or an extended month. A moon that is seen on the night of the thirtieth is called a moon seen in its proper time; if it is seen on the night of the thirty-first, and not on the night of the thirtieth, it is called a moon seen on the night of its extension.

5. The sighting of the moon is not entrusted to every individual, as with the weekly Shabbos, where each person counts six days and rests on the seventh. Rather, the matter is entrusted to Beis Din, until Beis Din sanctifies it and establishes that day as Rosh Chodesh—then it becomes Rosh Chodesh. As it is stated: "This month shall be for you"—this testimony is entrusted "to you."

6. Beis Din calculates with calculations in the manner that astrologers calculate, who know the positions and movements of the stars, and they investigate and examine until they know whether it is possible for the moon to be seen in its proper time, which is the night of the thirtieth, or not possible. If they know it is possible for it to be seen, they sit and wait for witnesses all that day, which is the thirtieth day. If witnesses come, and they examine and investigate them according to Halachah, and their words are found trustworthy, they sanctify it. If it is not seen and no witnesses come, they complete thirty days, and the month is extended. If they know by calculation that it is impossible for it to be seen, they do not sit on the thirtieth day and do not wait for witnesses; and if witnesses come, it is certainly known that they are false witnesses, or that a form resembling the moon appeared to them from the clouds, but it was not the actual moon.

Laws of Sanctifying the New Month, Chapter 1

7. It is a positive commandment from the Torah for the Beis Din to calculate and determine whether the moon will be seen or not, and to examine the witnesses until they sanctify the month. They must then send word and inform the rest of the people which day is Rosh Chodesh, so that they will know on which day the festivals fall, as it is stated: "which you shall proclaim as holy convocations" (Vayikra 23:2, 23:37), and it is stated: "And you shall keep this ordinance in its appointed time" (Shemos 13:10).

8. Months are calculated and established, and years are intercalated, only in Eretz Yisroel, as it is stated: "For from Tziyon will go forth Torah, and the word of Hashem from Yerushalayim" (Yeshayahu 2:3; Michah 4:2). However, if there was a person of great wisdom who was ordained in Eretz Yisroel and then went abroad, and there remained no one in Eretz Yisroel equal to him, he may calculate and establish months and intercalate years outside of Eretz Yisroel. But if he learns that in Eretz Yisroel there is now a person of equal greatness to him—and certainly if there is someone greater than him—then it is forbidden for him to establish or intercalate outside of Eretz Yisroel. And if he did so and established or intercalated, his actions are of no effect.
