מאז שענינו "שהנקודה העקרית והעובדה המשפטית והמעשית . . היא שיש פסק דין ברור של הרבנות הראשית". ובמענה על זה שולח צילומי מכתבים וכו'. שלכאורה הפירוש בזה, שעל ידי כך יתברר שההנהגה בנוגע הרישום וההשתתפות בקואליצי' וכו' בסדר ובצדק וכו' וכו'.

מסופקני אם כוונת כ' היא להכנס לויכוח לשם ויכוח, שהרי המטרה היא – לברר הענינים לאמיתתם, וכנ"ל, העובדה המשפטית והמעשית ובקשר עם פס"ד ברור של הרבנות הראשית. ואת כ' הסליחה שמוכרחני לומר שמה שהוסיפו בזה צילומי המכתבים הוא שעוד הגדילו התמי' והקושי', באם לדבר בלשון נקי'. ואפרש דברי:

א. כשמר וחבריו שי', וככתבו, מרכז העולמי של

) מפרסם צילומים האמורים, הרי זה פרסום המאשר כי בעתו ובזמנו הי' פס"ד ברור של הרבנות הראשית, ושהגיע פס"ד זה להשרים אודותם מדובר בפס"ד האמור. זאת אומרת, שידעו על דבר פס"ד זה, ובפרט סעיף ד' שבו. המסקנה מזה, שכל אלה

שהכחישו בתוקף

(ההדגשה של העתון של המפד"ל, עפ"י הרשום בזכרוני) שיש פס"ד כזה, ואחר כך טענו שלא קבלו, היינו שלא הגיע להם, פס"ד האמור – הנה עכשיו המפד"ל וכל באי כוחה וההנהלה מפרסמים

שלא דברו נכונה

, אשר בודאי כל עסקן (ומפלגתו) ציבורי צריך להסיק המסקנות מזה, על אחת כמה וכמה כשהמדובר לא בציבור סתם כי אם ציבור דתי, שאז מעורב בדבר ענין של קדוש השם והפכו.

ומה הן המסקנות – הרי בודאי ידוע למר השקו"ט בכנסת בנוגע ל

שר החוץ

, אשר פלוני האשימו שאמר משהו בשם אדם מארה"ב והלה הכחיש את הדברים. והשקו"ט לא היתה מה צריכה להיות המסקנה, כי אם אך ורק האם ההאשמה מבוססת או לא.

ב. בצילומי המכתבים מדובר אך ורק בנוגע לסעיף הרביעי של הפסק דין, כלומר – ההשתתפות בקואליצי'. זאת אומרת, שהמפד"ל ובאי-כוחה מפרסמים ששאר הסעיפים בתוקפם עומדים, ביניהם

פס"ד ברור

, וז"ל: "ב) אסור עפ"י דין תורה לרושמי מרשם התושבים והאחראים עליהם, לרשום אינו יהודי כיהודי בעוד שלא נתגייר כהלכה". ["בין בארץ בין בחו"ל" (שם ס"א)].

והעובדה המעשית במצב העכשוי בזה הוא, כמו שנתפרסם הדבר פעמים רבות בעתונים וגם בכנסת, שרושמים אינם-יהודים כיהודים אף שלא נתגיירו כהלכה. [השקו"ט הוא אם נוהג זה הוא רק בנוגע לחו"ל, או גם באה"ק, שאין לפקיד רשות לחקור ולשאול בזה].

זאת אומרת, שהמפד"ל מפרסם שכל העושה בניגוד לסעיף ב' האמור של הפס"ד עובר על פס"ד ברור של הרבנות הראשית, ואף על פי כן עושה זה ובידיעה גמורה. במלים אחרות – סתירה מיני' ובי'.

ואני חוזר ומדגיש, שהפרסום פירושו, אשר פלוני מפרסם שסעיף האמור בתוקפו עומד, והוא ממשיך בהרישום כמו שהי' עד עתה למרות פס"ד זה, ומבקש את סניפי המפד"ל באה"ק ובחו"ל לפרסם על דבר הנהגתו זו ג"כ.

ג. פסק דין הרבנות הראשית נתקבל פה אחד על ידי חברי כל המועצה. ובודאי אשר לדכוותי' דמר שהוא עו"ד וכפי ששמעתי וגם ממנו יש לו גם סמיכה לרבנות, אין צורך בביאור כלל אשר אין בכח יחיד, יהי' מי שיהי', לבטל פס"ד זה, ולא עוד אלא אפילו לא לפרשו בענין עקרוני מבלי שישתתפו בזה אלו שפסקו את הדין ויחוו דעתם בזה ויפרסמוה באופן כמו שנתפרסם הפס"ד. הדבר פשוט עד כדי כך שאין זקוקים בזה לבירור מרב או עו"ד, כי זה גם שכל הפשוט, שאי אפשר לשותף אחד או חלק מהשותפים לבטל החלטת כל השותפים, על אחת כמה וכמה החלטה שנתקבלה פה אחד.

אינני רוצה להכנס לשקו"ט בנוגע למכתבים עצמם, שהרי אין הם מכתבי מר ולא הוא האחראי עליהם. על כל פנים – כיון שהוא אחד מהמפרסמים אותם ומעורר גם אחרים לפרסמם, אתעכב עכ"פ על נקודה אחת בצילום המכתב של י"א ניסן, וז"ל: "חיווינו דעתנו כך, בין השאר, על שום שאותה שעה עמדה להכרעה מידית שאלה של הכרה בגיור שנעשה שלא כהלכה".

וזה לשון הפס"ד האמור, בסעיף ד' שלו: "ד) אם ח"ו לא יתוקן החק כנ"ל על הנציגים הדתיים לעזוב הממשלה, כי לא יתכן להשתתף באחריות הענין כחברי הממשלה".

הרי זה פסק דין ברור – הפסק עצמו וכן התנאי לקיום הפסק או לביטולו: תנאי אחד ותו לא – תיקון החק כנ"ל. ובכל הפס"ד מתחילתו ועד סופו אין כל זכרון על דבר "הכרעה מידית" וכו', כי אם אך ורק תיקון החק.

ולהעיר שבצילום מכתב השני מו' ניסן ג"כ מודגש פעמים שרק בתיקון החק תלוי הפס"ד ואין כל זכרון כלל ל"הכרעה מידית" וכו'.

מביא אני האמור רק כהערה, שהרי כנ"ל בנוגע לפס"ד גמור של מועצת הרבנות הראשית אין בכח של יחיד או אפילו של כמה וכמה יחידים לשנות אותו, וכנ"ל.

לסיכום האמור: העובדה המעשית והמשפטית גם עתה – כמו שהיתה בעת כתיבת מכתבי הקודם, היינו שיש פסק דין ברור של הרבנות הראשית, שעתה גם המפד"ל ובאי כוחה וההנהלה שלה מודים בזה בפומבי, אלא שמוסיפים שישנם מכתבים של יחידים ובנוגע לסעיף רביעי שבו, ומכתב אחד סותר את השני, ובכל אופן אלו הם מכתבים של יחידים אשר תוכן המכתבים עצמם מאשר עוה"פ שישנו פס"ד גמור של הרבנות הראשית בהשתתפותם.

מה שיש להוסיף בזה, לאחרי בקשת סליחת מר, שכל המפרסם צילומי מכתבים אלה – גורם הוא לא להרמת כבוד הרבנות הראשית ולא להרמת קרן הדת בכלל, שהרי כל הנקודות המנויות לעיל מובנות הן ופשוטות לעיני כל. ומפורסם הפירוש שנותנים איך זה נשתלשל המצב בענין זה עד לפירסום המכתבים הנ"ל.

לסיום מכתב כת"ר אשר ישנן שמועות וידיעות שלעתים הן רחוקות מן האמת וכו' וכו', יכולני להבטיח את מר אשר קודם שאני מדבר ברבים על דבר שמועה ואיני מקדים שזוהי שמועה בעלמא, בודק אני את השמועה יפה יפה בכל הדרכים האפשריים, ות"ל אשר עד עתה

כל

השמועות שבדקתי נתבררו שהבדיקה היתה כדבעי. ובענין זה עצמו: כשאמרתי שישנו פס"ד ברור, והכחישו בתוקף, נתברר כנ"ל; כשאמרתי שהפס"ד נשלח לפלוני ופלוני, והכחישו גם זה, נתברר כהנ"ל, וכו' וכו'.

הענין אודותיו כותב מר שלחצו על רב מפורסם בקשר עם דירה כו' הרי – בזמנו – הלחץ הגיע עד כדי כך אשר בעה"ב אחד, שמכירו אני אישית (ידיד נלהב של הרב – וגם הוא אישר את הענין), הציע והי' מוכן לקנות את הדירה בכסף מלא בשביל לבטל את הלחץ.

נ.ב. הבא לקמן לא רציתי לכלול לעיל מכמה טעמים מובנים.

א) ראיתי שקו"ט במכ"ע אשר השרים הדתיים לא לחצו בנוגע לדירה. מה שאמרתי, וחוזר אני עוה"פ הוא שבאי כח המפד"ל לחצו.

ידוע לי גם השם של המתחיל בלחץ זה, חבר הנשיאות של המזפה"מ, אבל איני רואה תועלת לנקוב בשם, כיון שגם למר בודאי ידוע זה.

ב) לכתבו במכתבו ע"ד היחס כל משך השנתים בין הרבנות הראשית והשרים וכו',

(א)

הכלל

של חכז"ל לא שבק היתרא ואכל איסורא, אין זה ענין בלי טעם וגזרת הכתוב, כי אם בטבע בני אדם. ואם איתא אשר תיכף לאחרי המאורע שעמד להכרעה מידית בטל הפס"ד, איך מבאר מר את התופעה אשר (1) צריכים היו להכחיש בתוקף מציאות פס"ד זה, בה בשעה שהי' אפשר לומר בפשטות כנ"ל, (2) למה הוצרכו לומר דבר "מוזר" – שלא הגיע הפס"ד לאותם שלהם נוגע הפס"ד, (3) מה מקום הי' לפרסום על ידי

שלפני מכתבו זה, מכתב בן שמונת עמודים, אין בו אף מלה אחת ע"ד ביטול הפס"ד בעקבות הכרעה מידית וכו' וכו'. שלכאורה הרי זוהי תמי' הכי גדולה, [נוסף על הנקודה – שאין מזכיר עד"ז, ועל אחת כמה וכמה שאין מבאר בזה כלל, במכתבו זה מי"ב ניסן].

I acknowledge receipt of your letter from the 2nd of Nissan, with its attachment, which arrived after some delay, and I thank you for it. Regarding the content of your letter and its beginning—which refers to my previous letter where I stated that the main point and the legal and practical fact is that there is a clear ruling from the Chief Rabbinate—and in response you sent copies of letters, etc., it seems that by this you wish to clarify that the conduct regarding registration and participation in the coalition, etc., is proper and just.

I am unsure if your intention is to enter into an argument for its own sake; after all, the goal is to clarify matters truthfully—as above—the legal and practical fact in connection with a clear ruling from the Chief Rabbinate. Please forgive me for saying that adding these copies only increases confusion and difficulty—if I may speak delicately.

Let me explain: A) When you and your colleagues—as you wrote—the World Center of Mizrachi (i.e., Mafdal) publish these copies, it is a publication confirming that at its time there was a clear ruling from the Chief Rabbinate, and that this ruling reached the ministers concerned. This means they knew about this ruling—especially section D within it. The conclusion: all those who strongly denied (as emphasized by Mafdal's newspaper, as I recall) that such a ruling existed, or later claimed they never received it—that is, it never reached them—now Mafdal and all its representatives publicly admit they did not speak truthfully. Certainly every public activist (and his party) should draw conclusions from this—how much more so when dealing not with just any public but a religious one, where issues of sanctification or desecration of G‑d's name are involved.

And what are those conclusions? Surely Mr. Shakot in Knesset regarding the Foreign Minister—who was accused by someone of saying something in the name of an American who denied it—the only thing to consider was whether or not the accusation was substantiated.

B) The copies concern only section four of the ruling—that is, participation in the coalition. Meaning Mafdal and its representatives publish that all other sections remain valid—including a clear ruling: "B) It is forbidden according to Torah law for registrars of population records or their supervisors to register a non-Jew as a Jew unless he converted according to Halachah [whether in Israel or abroad]." The current practical reality—as has been reported many times in newspapers and even in Knesset—is that non-Jews are registered as Jews even though they have not converted according to Halachah [the question being whether this applies only abroad or also in Israel; officials are not authorized to investigate].

This means Mafdal publishes that anyone acting against section B of this ruling violates a clear decision by the Chief Rabbinate—and yet does so knowingly. In other words—a contradiction within itself. I emphasize again: publication means someone publishes that this section remains valid while continuing registration as before despite this ruling—and asks Mafdal branches in Israel and abroad to publicize his conduct as well.

C) The Chief Rabbinate's ruling was accepted unanimously by all council members. Certainly for your honor—as I have heard also from you—you have rabbinic ordination; there is no need to explain that no individual can annul such a ruling—not even interpret it fundamentally—unless those who issued it participate and express their opinion publicly as with the original decision. This is so obvious it needs no clarification from either rabbi or lawyer; it's simple logic: one partner or part cannot annul a unanimous decision—how much more so when unanimously accepted.

I do not wish to enter into debate about these letters themselves—they are not your letters nor are you responsible for them. Nevertheless—since you are among those publishing them and encouraging others—I will pause on one point regarding the copy dated 11 Nissan: "We expressed our opinion thus... because at that time an immediate decision was needed about recognizing conversions done improperly." But here is what section D says: "D) If by Nissan 15th (Pesach) the law is not amended as above, religious representatives must leave government since it's impossible to share responsibility as cabinet members." This is a clear-cut decision—the condition for maintaining or annulling it: one condition only—the amendment of law as above. Nowhere throughout does it mention an immediate decision; only amending law.

Note also that another letter copy from Nissan 6th emphasizes twice that everything depends solely on amending law—not any immediate decision at all.

I mention this only as an aside—for regarding a full-fledged decision by the Chief Rabbinate Council no individual—or even several individuals—can change it.

To summarize: The legal and practical fact now—as at time of my previous letter—is there remains a clear ruling by the Chief Rabbinate; now even Mafdal and its representatives admit this publicly—but add there are private letters concerning section four which contradict each other; but these are private letters whose content itself confirms again there exists an unequivocal Chief Rabbinate decision with their participation.

What must be added—with apologies—is anyone publishing these copies does not elevate respect for either Chief Rabbinate or religion generally—for all points above are self-evident to any observer. It’s well known how things developed until these letters were published.

To conclude your letter—which mentions rumors sometimes far from truth—I can assure you before speaking publicly about any rumor without first clarifying it's just hearsay—I thoroughly check every rumor by every possible means—and thank G‑d until now every rumor I've checked proved my investigation was proper.

Regarding this matter itself: when I said there was a clear ruling—and they strongly denied—it turned out as above; when I said rulings were sent to certain people—and they denied—it turned out likewise; etc., etc.


Summary

The Rebbe teaches here that communal decisions made unanimously by rabbinic authority cannot be overturned by individual opinions or private correspondence; clarity and integrity must guide public discourse on matters affecting Jewish identity and halachic standards.
