שלום וברכה!

הנני מאשר קבלת מכתבו מכ"ב שבט, ולאחר בקשת רוב סליחתו מוכרחני לומר שהופתעתי מתוכנו, ובפרט מהתחלת המכתב בו כותב שרואה "חובה דתית-מוסרית לעצמי להעמיד הדברים על אמיתתם ודיוקם. גם כשנטושה מחלוקת לשם שמים על מצב מסוים וכל דרכי הטיפול בו, יש לשמור על קו האמת מכל משמר". וכן סיומו מעין הפתיחה: "גם בשעת מחלוקת, חובה לדעת ולהודיע את העובדות המשפטיות והמעשיות לאמיתן",

ולאחרי שעיינתי בכל שמונת העמודים שבמכתב, ראיתי שהנקודה

העיקרית

שבכל הענין נעלמה בו

בחוק הוא שורש כל הבעיות ואם רק יתוקן שוב יבוא הכל בשלום; שבודאי הכוונה בזה, וכמוכח ג"כ מהמשך המכתב, תיקון החוק על ידי הוספת ההגדרה "כהלכה" (גיור כהלכה), וכן בנוגע להזכויות הניתנות לזוגות מעורבים וכו',

שהנקודה העקרית בזה והעובדה המשפטית והמעשית, שכאמור לא נגע בה כלל במכתבו, היא: שיש

-דין ברור של הרבנות הראשית – ויש להדגיש שהפס"ד נתקבל פה אחד – הקובע העובדות באופן חד-משמעי, וז"ל וכבר נתפרסם ברבים:

מועצת הרבנות הראשית לישראל בישיבתה מיום ה' ער"ח סיון תש"ל, דנה בכובד ראש על המצב המסוכן שיתהווה על-ידי שלא הודגש בפירוש בחק . . שהגיור יהי' כהלכה, דבר שיזעזע את כל בית ישראל מקצה עולם ועד קצהו, ויפלג את העם פילוג שלא הי' כמוהו למן

סור

אפרים מעל יהודה, והחליטה פה אחד:

א. כל גיור שנעשה, בין בארץ ובין בחו"ל, שלא כדין וכהלכה הקבועה ועומדת למן סיני ועד הנה, – איננו גיור. ואין לא-יהודי נעשה ליהודי אלא על ידי גיור כהלכה.

ב. אסור על פי דין תורה לרושמי מרשם התושבים והאחראים עליהם, לרשום אינו יהודי כיהודי בעוד שלא נתגייר כהלכה.

ג. הרבנות הראשית פונה לממשלה בבקשה נמרצה להביא בכנסת תיקון להחק ע"י תוספת המלה "כהלכה".

ד. אם ח"ו לא יתוקן החק כנ"ל על נציגים הדתיים לעזוב את הממשלה, כי לא יתכן להשתתף באחריות הענין כחברי הממשלה.

הנ"ל הוא בהנוגע להתחלת וסיום מכתב כ' (אשר תוכנו בא לבאר את ההתחלה ואת הסיום).

ב. ועוד ועיקר מה שיש להוסיף בזה, לאחרי פס"ד האמור, אשר כפי ידיעותי בדברי ימי עמנו בני ישראל בכל התקופות לא מצאתי מקרה דומה, אשר יכריזו ובקול גדול ובפרסום הכי גדול, אשר פב"פ הוא הרב המוסמך שלהם וסמכותו צריכה להתקבל על כל אחד ואחד ובזה תלוי קיום הדת וכו' וכו', ובבת אחת עם הכרזה זו, וג"כ בפרסום ובפרהסיא, יפעלו בניגוד גמור להפס"ד הברור של אותה הרבנות המוסמכת.

כוונתי כפשוטה לסעיף (ד) הנ"ל הקובע כי לא יתכן להשתתף באחריות הענין, ולכן על הנציגים הדתיים (לצאת מן הקואליצי') לעזוב את הממשלה. וכן להסעיף (ב) האוסר על הפקידים ועל

האחראים עליהם

לרשום אינו יהודי כיהודי בעוד שלא נתגייר כהלכה.

ג. מה יענה כ' על השאלה: באיזה תוקף יכול כ' וחבריו שי' לתבוע מהממשלה שיישמעו לתביעות הדתיות, בה בשעה שהם עצמם עוברים על הפס"ד הברור האמור שניתן מאותה הסמכות הרבנית אשר משרדו של כ' משלם לו משכורת בעד פעולותיו הרבניות, מתעסק בשקו"ט בנוגע לפרטי הנהלת הרבנות וכו'?

אפשר עוד להאריך בכל האמור, וכן בכמה נקודות אשר במכתב כ', אבל לצערי הגדול נוכחתי אשר באם מוסיפים משהו, הרי כמה אנשים נטפלים לענין טפל או גם לפרט שאינו שייך לכל הענין הנידון, למרות הרציניות והחיוניות שבענין, ובלבד שבאופן רשמי יהי' מענה, אף שהמענה הוא בגדר

"טענו

בחיטים והודה לו בשעורים" או אף גרוע מזה, וכטענה הידועה, איך אפשר לאיש אשר מעולם לא ביקר באה"ק ת"ו לומר אשר כתוב בספרים הוראה פלונית בנוגע לענין פלוני אשר באה"ק ת"ו.

החותם בצער רב על המצב המבהיל ובפרט אשר כנראה מתוכן מכתב כ' רוצים שיעלימו עין מנקודה העיקרית שבזה ו"מכסים" זה בשקו"ט אשר במצב ההוה אינו נוגע כלל וכלל,

ויהי רצון אשר, בסגנון כ', ידעו כל אחד ואחת העובדות המשפטיות (ובודאי אשר

משפט

תורתנו תורת אמת אינו גרוע ח"ו משיחה בטלה שלהם) והמעשיות לאמיתן – המציאות כמו שהיא: שיש פס"ד הרבנים בנוסח חד-משמעותי וכו'.

(א) אשר מותר לכל אחד ואחת למרוד בפס"ד ברור של הרב שלו, ואף על פי כן לא יפגע זה בדתיות שלו וכו'.

(ב) אשר אפשר להחתים אנשים מבלי ידיעתם והיפך השקפת עולמם.

(ג) מותר לעשות זה אפילו בענין הקשור באמונתם של אנשים אלה ודתיותם, או במלים אחרות, להחתים אדם על השקפה אשר לדעתו היא מרידה בתורתו שקבל על עצמו ונגד מצפונו.

ובודאי אשר לדכותי' דמר אין צורך להסביר מהו הצד המשפטי והמעשי דהנ"ל, כסגנון מכתבו, ובסגנון ברור יותר, נקודת היסוד של השקפת עולמו של כל מאמין ועל אחת כמה וכמה של עם מאמינים

Shalom u'Vrachah!

I hereby acknowledge receipt of your letter from the 22nd of Shevat. After asking your forgiveness, I must say I was surprised by its content—especially by its opening in which you write that you see it as a religious-moral duty to clarify matters truthfully and precisely. Even when there is a dispute for the sake of Heaven about a particular situation and how to address it, one must guard the line of truth above all else. The letter’s conclusion echoes its opening: even in times of dispute, it is an obligation to know and inform others of the legal and practical facts as they truly are. After reviewing all eight pages of your letter, I saw that its main point was entirely omitted—namely (in your own words): whether amending the law is the root of all problems and if everything will be resolved peacefully once it is amended; clearly referring—as is evident from your letter—to amending the law by adding a proper definition (halachic conversion), as well as regarding rights granted to mixed couples, etc. The main point here—the legal and practical fact which you did not address at all—is that there is a clear ruling from the Chief Rabbinate—and it should be emphasized that this ruling was unanimous—determining these facts unequivocally. Its wording has already been published widely: The Council of the Chief Rabbinate of Israel, in its session on Thursday, Eve of 8 Sivan 5730 (1970), deliberated seriously on the dangerous situation arising from not explicitly stating in law that conversion must be according to halachah—a matter that would shake all Israel from one end of the world to the other and split the nation as never before since Ephraim separated from Yehudah—and decided unanimously: A) Any conversion performed—whether in Israel or abroad—not according to Torah law as established since Sinai until now is not a conversion; a non-Jew becomes Jewish only through halachic conversion. B) According to Torah law it is forbidden for those registering residents or their supervisors to register a non-Jew as Jewish unless he converted according to halachah. C) The Chief Rabbinate urgently requests that the government bring an amendment before Knesset adding "according to halachah" into the law. D) If G‑d forbid this amendment is not made, religious representatives must leave the government because it is impossible to share responsibility for this matter as members of government. This relates directly to both the beginning and end of your letter (whose content seeks to explain both).

Furthermore—and most importantly after this ruling—which as far as I know has no precedent in our people’s history: that there should be a public declaration—loudly and widely—that so-and-so is their authorized rabbi whose authority must be accepted by everyone and upon whom religious continuity depends—and at once with this declaration (also publicly), they act completely contrary to this clear ruling by that same authorized rabbinate! My intention is simply regarding clause (D) above which states it is impossible to share responsibility for this matter; therefore religious representatives (to leave coalition) must leave government. Likewise clause (B) forbids officials or their supervisors from registering a non-Jew as Jewish unless he converted according to halachah.

What answer does your honor have for this question: With what authority can you and your colleagues demand from government that they heed religious demands when you yourselves violate this clear ruling issued by that same rabbinic authority whose salary comes from your office for his rabbinic activities and who deals quietly with details concerning management of the rabbinate?

One could elaborate further on all this—as well as on several points raised in your letter—but unfortunately I have found that if anything more is added some people latch onto irrelevant details or even unrelated particulars just so there will be an official response—even if such response amounts to "he asked about wheat but answered barley," or worse; like someone claiming knowledge about something he never visited just because he read about it somewhere.

I sign with deep distress over this alarming situation—especially since it seems from your letter’s content there are efforts being made to obscure its main point and cover it up with silence which under current circumstances has no relevance whatsoever. May it be G‑d’s will—in your own style—that everyone knows both legal facts (and certainly Torah law—Torat Emet—is no less than their idle talk!) and practical realities as they truly are: namely that there exists a clear rabbinic ruling formulated unequivocally.


Summary
