ואואפ"ל: הא דהתנה מהני - כמש"כ באגה"ת - הוא מהירושלמי. ולפי גירסת הירוש' באותה ברייתא (תענית פ"א ה"ד) רשב"ג (במקום ראב"ש בבבלי) והכלל לכמה פוסקים (הובאו ביד מלאכי) דהלכה כרשב"ג לגבי רבי מותר רק עד קריאת הגבר (ודלא כפסק השו"ע סתקס"ד). ולמפרש בתמיד (כו, א) שזמנו שליש הלילה לאחר חצות ולמסקנת אדה"ז בסידורו שהיום הוא מנץ החמה - ה"ז לערך (וכהל' באגה"ת כ ג') ג"ש לפני נה"ח.
- ומש"כ בזח"ב (קצה, ב) והובא להלכה בשו"ע או"ח סמ"ז שקרה"ג הוא בחצות לילה - ע"פ המשנה דיומא (כ, א) עכ"צ לחלק בין קרא פ"א לשנה ושילש (ראה שם כא, א). - וצע"ק מרש"י ד"ה ולינה (זבחים כ, א) האי פורתא כו'. וראה ג"כ תוד"ה קורין (סוכה כא:). ואין הזמ"ג להאריך בכ"ז.

Regarding what you raised about the Alter Rebbe's Tanya, chapter 3, "about three hours before dawn"—this has already been discussed by earlier Chassidim, but I have not heard a clear explanation. In Responsa Maharshag II (to R. Sh. Greenfeld, Bardiyov 1939) (section 34, p. 75), he explains that in Lithuania this is the time of dawn or half an hour before it. However, with all due respect, his words are not entirely convincing.
I would suggest: The condition being effective—as written in Tanya—is from the Yerushalmi. According to the Yerushalmi's version of that Baraita (Taanit 1:4), Rashbag (instead of Raavash in the Bavli) is cited, and the rule for many halachic authorities (brought in Yad Malachi) is that the law follows Rashbag over Rabbi; thus it is permitted only until 'the call of the rooster' (and not as ruled in Shulchan Aruch OC 564). According to the explanation in Tamid (26a) that its time is a third of the night after midnight, and according to the conclusion of the Alter Rebbe in his Siddur that 'the day' begins at sunrise—this would be approximately (as stated in Tanya ch. 3) three hours before sunrise.
What is written in Zohar II (165b) and brought as law in Shulchan Aruch OC 237—that 'the call of the rooster' is at midnight—based on Mishnah Yoma (20a), must be distinguished between reading once and repeating twice or thrice (see there Yoma 21a). Further investigation is needed regarding Rashi's comment on Zevachim 20a s.v. "and lodging"—this little bit etc. See also Tosafot s.v. "they read" (Sukkah 21b). There isn't enough space here to elaborate on all this.
