שו"ת ס"א. כו"כ משומרי תומ"צ מקילין בהאטעלס [כ"ק מו"ח אדמו"ר לא הי' מטלטל בש"ק בפרוזדרי האטעלס] ולכאורה יש להם על מה שיסמוכו סמיכה חזקה: א) עפמשנ"ת טעם ההיתר ביש לבעה"ב כלים בבתים כיון שזה מראה שלא סילק עצמו מבתים אלו מכל וכל כו' נעשה כאילו דר בהם כו' נעשו כולם כאורחים אצלו (שו"ע רבנו הזקן סש"ע ס"ב) - והרי כמה הגבלות ישנם בשכירות חדר בהאטעל לגבי שכירות דירה באופן הרגיל.

ב) כמעט תמיד נמצאים בחדר חפצי בעה"ב שאין השוכר משתמש בהם כלל, והוי תפיסת ידו, אפילו באם היתה שכירות ממש.

ג) להפמ"ג סש"ע א"א סק"ג (ודלא כמשנ"ב) עו"ש ותוס"ש - באם יש לבעה"ב רשות להניח ג"כ מספיק.

ד) מתארחים לפחות מל' יום, ואפילו אלו הדרים יותר משלמים השכירות מדי שבוע בשבוע ואז ברשות בעה"ב לסלקו לגמרי (כי אין כל חוזה, ודלא כשכירות בתים) ז.

א. שבכל שבוע נתחדשה דירתו. וראה שו"ע אדה"ז סו"ס ש"ע דאפילו הקובע ליותר מל' יום אינו אוסר עד לאחר ל' יום, וא"כ אפילו המשלמים אחת לחודש ע"פ מספר העמים שיש בהם חדש של ל"א יום, אינו אוסר מלבד באם חל יום הל"א בש"ק ורק ש"ק זה. - ועיין א"ר וביאור הלכה להמשנ"ב סו"ס ש"ע בנוגע ליום ל'.

ובשו"ת מהרש"ג ח"ב (בארדיאב תרצ"ט) סקכ"ג התיר בהרוחה מטעמים א' ג' הנ"ל.

ומסיים בראי' מהא דאין קובעין מזוזה בכהנ"ל אפילו המתארחין (בהאטעלס דנכרים) יותר מל' יום.

סוגיות. בתחלתן. צע"ג בישוב דעת הרמב"ם - דהרי ס"ל דקדשים שחוטים נדחים (הל' פסוהמ"ק פ"ג הכ"ב. וראה ג"כ כ"מ הל' ע"ז פ"ז ה"י, רמב"ם הל' פסוהמ"ק פ"ב הכ"ב) והד"ס צ"ל דינו כשחוטים ולא כבע"ח.

הדרן לש"ס. אריב"ל כו' צדיק וצדיק - ומפרש הכפל, צדיק ובע"ת. ואף דאין משיבין על הדרש (שער הפסוקים להאריז"ל עה"פ וימררו את חייהם) יש להעיר דמסייע לי' מקדושין (מט, ב) אשר גם להלכה בודאות קורין לבע"ת צדיק.

ומענין ימים אלה - מרז"ל זה דלכל צדיק וצדיק כו' הוא דלא כר"ח בר אבא אר"י (ברכות לד, ב). וי"ל דזהו ג"כ היסוד להפס"ד (רמב"ם ועוד. וראה ג"כ אגרת התשובה לרבנו הזקן ספ"ח) כמאן דפליג עלי' ואמר מקום שבע"ת עומדין צד"ג אינם עומדין.

As the new year approaches for us and all of Israel for good and blessing, I hereby express my blessing to your honor and all that is yours: a blessing for being inscribed and sealed for a good and sweet year in both material and spiritual matters.

P.S. I again thank you very much for your gift—your sefer "Chemdat Moshe," responsa on the four sections of Shulchan Aruch. Although this time is not at all conducive to study due to the matters of these days, as is known from the words of the Birkei Yosef (also brought in Elef Lamateh on Mateh Ephraim section 581:15), nevertheless out of affection for the matter I noted at least in a few places some brief comments. Introduction at its beginning: On Ohr HaChaim on the verse "Vayeshev HaYam..." See Or Torah by the Maggid of Mezritch on this verse. And a story from my father-in-law the Rebbe zatzal (copied in Hayom Yom Parshas Beshalach). Opening at its beginning: Section 2-3. Note from Yerushalmi Taanis chapter 1 halacha 1: among five things etc., "Vayar Batzar..." Responsa section 1.

Many among those who observe Torah and mitzvos are lenient regarding carrying in hotels [my father-in-law the Rebbe would not carry on Shabbos in hotel corridors], and it seems they have strong grounds to rely upon: A) According to what is explained as the reason for leniency when a homeowner has utensils in houses—since this shows he has not completely removed himself from these houses etc., it is as if he still lives there etc., so all are considered his guests (Shulchan Aruch HaRav Orach Chaim section 382:2)—and there are many limitations regarding renting a room in a hotel compared to regular apartment rental. B) Almost always there are items belonging to the owner in the room that the renter does not use at all; this constitutes his possession even if it were a real rental. C) According to Pri Megadim Orach Chaim Eshel Avraham section 382:3 (unlike Mishnah Berurah), see there and Tosafos Shabbos—if the owner has permission to also store enough items there. D) Guests stay at least thirty days, and even those who stay longer pay rent weekly, so the owner can remove them entirely (since there is no contract, unlike house rentals). Therefore, each week their residence is renewed. See Shulchan Aruch HaRav end of section 382 that even one who sets up for more than thirty days does not prohibit until after thirty days; thus even those paying monthly according to nations with months of thirty-one days do not prohibit except if day thirty-one falls on Shabbos—and only that Shabbos. See also Eliyah Rabbah and Biur Halacha by Mishnah Berurah end of section 382 regarding day thirty. In Responsa Maharshag vol. II (Bardiyev 1939) section 123 he permitted broadly based on reasons A and C above, concluding with proof from the fact that one does not affix a mezuzah in such cases even if staying (in non-Jewish hotels) more than thirty days.

It requires further clarification regarding Rambam's opinion—for he holds that slaughtered offerings become disqualified (Hilchos Pesulei HaMukdashin ch.3 halacha 22; see also Kesef Mishneh Hilchos Avodah Zarah ch.7 halacha 10; Rambam Hilchos Pesulei HaMukdashin ch.2 halacha 22), so logically their status should be like slaughtered animals rather than living ones.

Conclusion to Shas: Rabbi Yochanan says... "Tzaddik v'Tzaddik"—and explains the repetition as referring to a tzaddik and a baal teshuvah (penitent). Even though we do not respond to drashot (Shaar HaPesukim by Arizal on "Vayemareru Es Chayeihem"), it should be noted that Kiddushin (49b) supports this—that even according to halacha we certainly call a baal teshuvah a tzaddik.

Regarding these days—it is from our Sages' statement that for every tzaddik... etc., which disagrees with Rav Chanina bar Abba quoting Rabbi Yochanan (Berachos 34b). It may be said that this too is the basis for the ruling (Rambam et al.; see also Iggeres HaTeshuvah by Rabbeinu HaZaken end ch.8) following those who disagree with him and say "In the place where baalei teshuvah stand, complete tzaddikim cannot stand."
