במענה להערתו - שמפני סיבה נשמט המענה במכתבי מאז.

בקונטרס עץ החיים פרק כ"ט שכתוב "דר' זירא ג"כ הי' מסיק שמעתתא אליבא דהלכתא אלא שהוא מתוך הפלפול (וכ"כ בשערי אורה שם)", דלדעתו בשערי אורה לא מבואר כך.

ולפע"ד הכוונה על מ"ש שם בד"ה בכ"ה בכסלו פרק נ"ו "ובאמת אא"ל שחריף ומקשה אינו רק שמקשה קושיות בלתי יבוא לפסק הלכה, כמו רבה חריף ומקשה כו'" שמובן שה"ה גם לרבי זירא, ומתחזקת ראי' זו ממ"ש להלן שם בדוגמא לחריף ומקשה שלא יהי' מסיק הלכתא, כמו תל' א' מב"ש וכו' או כתלמיד ר' מאיר וכו', אלא שאין הלכה כמותם, משא"כ רבי זירא.

דא"ג ושייך גם להנ"ל, בלמדי בש"א מאז, נתעכבתי על מ"ש "כמו רבה חריף ומקשה", בשנים:

א) הלשון המובא בסוף הוריות על רבה הוא עוקר הרים (אף שהתוכן אחד).

ב) למה הביא הדוגמא מרבה, בה בשעה שעל אתר גופא נמצא לשון חריף ומקשה על רבי זירא.

ולולי דמסתפינא, הייתי אומר שטעות הדפוס הוא בזה [ויש לעיין בדפוסים הראשונים], ובמקום רבה צ"ל בש"א - ר"ז (רבי זירא), שבזה מובנות כפשוטן שתי נקודות האמורות, ובד"מ אתיא כפשוטו גם מ"ש בקונטרס עץ החיים.

In response to your comment—that for some reason my reply was omitted from my previous letter. In Kuntres Etz HaChaim chapter 29 it is written: "Dr. Zeira also would conclude matters according to halachah, but through pilpul (and so it is written in Shaarei Orah there)," while you maintain that in Shaarei Orah it is not explained this way.

In my opinion, the intent is what is stated there in the discourse of the 25th of Kislev, chapter 56: "And truly one cannot say that someone sharp and questioning is only one who asks questions without arriving at a halachic ruling, like Rabba who was sharp and questioning etc.," from which it is understood that this also applies to Rabbi Zeira. This proof is strengthened by what is written further there as an example of someone sharp and questioning who does not reach a halachic conclusion—like a certain student from Beit Shammai etc., or like a student of Rabbi Meir etc.—but the halachah does not follow them, unlike Rabbi Zeira.

Incidentally, and this also relates to the above: when I studied in Shaarei Orah back then, I focused on what was written "like Rabba who was sharp and questioning," for two reasons: (a) The phrase cited at the end of Horayot about Rabba is "uprooting mountains," even though the content is similar; (b) Why bring an example from Rabba when right there the phrase "sharp and questioning" appears about Rabbi Zeira? If not for my hesitation, I would say this is a printing error [and one should examine early printings], and instead of Rabba it should read in Shaarei Orah—RZ (Rabbi Zeira), which would straightforwardly resolve both points mentioned above, and generally fits with what is stated in Kuntres Etz HaChaim.
