Introduction

תר ביצה שנולדה בראש השנה וסדר הקידוש ובו ז' סעיפים:

א אף בני ארץ ישראל, עושין שני ימים ראש השנה.

לפי, שמה שהן אין עושין שאר מועדות אלא יום אחד, הטעם:

משום שאנו בקיאין בחשבון קביעות החדשים, ואנו יודעים יום שראוי לקבוע החודש ולמנות ממנו המועדות.

ואף בני גולה אין עושין שני ימים, אלא משום שהם צריכין לקיים מנהג אבותיהם, שהיו עושים שני ימים.

בזמן שהיו מקדשין על פי הראיה, שאין הדבר תלוי בחשבון כלל, אלא בראיית הלבנה, ולא היו בני גולה יודעין יום שהוקבע בו החודש בירושלים, והיו עושין שני ימים מספק.

אבל בני ארץ ישראל הקרובים לירושלים, לא היו עושין המועדות אלא יום אחד.

לפי שהבית דין שבירושלים היו שולחים שלוחים להודיע להם יום שנקבע בו החודש בניסן (ובסיון) ובתשרי.

ובכל המקומות הקרובים שהיו השלוחין מגיעין אליהם קודם יו"ט, לא היו עושין אלא יום אחד.

ולפיכך אף בניהם אחריהם עכשיו, אינן צריכין לעשות שני ימים, כיון שאנו בקיאים בחשבון ויודעים יום שראוי לקבוע בו החודש, ולמנות ממנו החודש.

וזה הטעם [1] לא שייך אלא בשאר מועדות, חוץ מראש השנה.

אבל בראש השנה אף בני ארץ ישראל צריכים לקיים מנהג אבותיהם, שהיו עושין שני ימים בזמן שהיו מקדשין על פי הראיה, שלא היה הדבר תלוי בידיעת החשבון אלא בקביעות הבית דין שבירושלים על פי ראיית (העדים את) הלבנה.

ואף על פי שהבית דין היו משלחין שלוחים להודיע לכל, מכל מקום, בראש השנה שהוא יו"ט, אין השלוחים יכולים לצאת חוץ לתחום:

 

ב ואף בגולה, ראש השנה הוא חלוק משאר מועדות.

ששאר מועדות אף אבותיהם לא היו עושין שני ימים אלא מחמת הספק, שלא היו יודעים יום שהוקבע בו החודש בארץ ישראל.

וביצה שנולדה ביום ראשון מותרת ביום שני.

שאם היום קודש, למחר הוא חול, ואין בו איסור מוקצה ונולד.

ואם למחר קדש, היום חול, וכבר הוכנה הביצה מערב יו"ט.

ולפיכך, אף בניהם אחריהם היודעים בקביעות החודש, ויודעים שיום ראשון הוא עיקר יו"ט, ויום שני הוא ג"כ יו"ט מדברי סופרים.

אעפ"כ אין דין ביצה זו כדין ביצה שנולדה בשני ימים טובים הסמוכים זה לזה, כגון שבת ויו"ט, שאם נולדה בזה אסורה בזה. כמ"ש בסי' תקי"ג.

דכיון שהן אין עושין שני ימים אלא מחמת מנהג אבותיהם, אין צריך להחמיר יותר מאבותיהם, שהיה מותר להם מטעם שנתבאר:

 

ג אבל בשני ימים טובים של ראש השנה אינו כן, אלא הן נחשבים כיום אחד ארוך.

וקדושה אחת הן, אף לבני ארץ ישראל.

וביצה שנולדה בראשון או דבר שנתלש מן המחובר בראשון או דבר שניצד בראשון, כשם שאסור בו ביום משום מוקצה ונולד, כך אסור ביום שני שהם כיום אחד ארוך.

חוץ מלענין מת ביום שני, כמ"ש בסי' תקכ"ו:

 

ד ולמה הן נחשבין כיום אחד, והרי אנו בקיאין בקביעות החודש, ואנו יודעין שראשון עיקר?

משום דאף הבית דין עצמן שהיו מקדשין על פי הראייה, היו עושין לפעמים שני ימים.

כיצד?

בראשונה כשהגיע יום ל' באלול היו כל ישראל והבית דין נוהגין איסור מלאכה וקדושת היום מבערב, דשמא יבואו עדים למחר ויאמרו שראו הלבנה בלילה זו, ויהיה היום ראש חודש תשרי, והוא ראש השנה, ונמצא שהלילה הוא יו"ט.

וביום היו הבית דין יושבין ומצפים לביאת עדים רואי הלבנה אולי יבואו.

וכל שעה שיבואו ביום, עד שתחשך, היו מקדשין את החודש אותו היום, והיה ראש השנה בו ביום.

ומאותו יום והלאה מונין ליום הכיפורים ולסוכות.

והיו תמיד רגילין לבוא קודם זמן מנחה, דהיינו זמן הקרבת תמיד של בין הערבים.

פעם אחת נשתהו העדים מלבוא עד אחר המנחה, והקריבו התמיד, ונתקלקלו הלוים בשיר, ואמרו שיר של חול, שהיו סבורים שלא יבואו העדים עוד היום, וכשבאו נמצא היום למפרע קודש.

ומאותו היום והלאה התקינו חכמים, שלא יהיו הבית דין מקבלין את העדים אלא עד המנחה.

וכשיבואו לאחר המנחה, יהיה אותו היום מן חודש העבר למנות אותו יום ל' של אלול, ולמנות ליום הכיפורים ולסוכות מיום המחרת.

שיש כח ביד בית דין לעשות דבר זה.

שנאמר, "אלה מועדי ה' אשר תקראו אותם", "אתם" כתיב, בלא וא"ו, אתם אפילו מזידין.

ומכל מקום אע"פ שאין מונין למועדות מיום זה, וכחול הוא חשוב, ויו"ט יהיה למחר.

אעפ"כ לא היו מזלזלים בו, והיו גומרים אותו באיסורו בקדושת יו"ט עד הלילה מדברי סופרים.

כיון שמן הדין היה הוא ראוי להיות יו"ט מן התורה, אלא שניתן רשות לבית דין לדחות.

ולמחר עושין יו"ט, וראש השנה של תורה.

ואלו שני הימים הן קדושה אחת, וכיום אחד ארוך, ושניהם נקראים יום טוב של ראש השנה, יום ראשון מדברי סופרים, ויום שני מדברי תורה.

והמקומות שהן חוץ לתחום של ירושלים, היו צריכין לעשות שני ימים ראש השנה בכל שנה ושנה, דשמא יבואו עדים אחר המנחה.

ונמצא ששני הימים הן קודש וכיום אחד הן חשובים, שהרי קדושה אחת עליהם, דהיינו קדושת ראש השנה.

ואחר יו"ט, כשהיו השלוחין יוצאין, (ו)היו מודיעים לכל בני ארץ ישראל יום שהוקבע בו החודש, והיו הכל מונין ממנו ליום הכיפורים ולסוכות.

וכך היה הדבר נוהג תמיד עד שבטלו סנהדרין ובטל קידוש החודש על פי הראיה, והתחילו לקבוע החדשים על פי החשבון.

ולפיכך הכל מונין מיום ראשון של ראש השנה ליום הכיפורים ולסוכות, לפי שעל פי החשבון אלול לעולם חסר.

ואעפ"כ צריכין הן לקיים מנהג אבותיהם שהיו בזמן קידוש החודש על פי הראיה, והיו עושין שני ימים טובים של ראש השנה אף בארץ ישראל, והיו עושין אותו כיום אחד ארוך, וקדושה אחת עליהן.

וביצה שנולדה בזה, אסורה בזה, מטעם שנתבאר, שמא באו עדים אחר המנחה.

לפיכך, אף שאין טעם זה שייך לזמן שקובעין חדשים על פי החשבון.

ולעולם יום ראשון הוא עיקר, והוא יו"ט של תורה.

מכל מקום אין לזלזל ביום שני, ולהקל בו, מה שלא היו מקילין בו אבותינו:

 

ה אף על פי שבכל יום טוב שני של גליות אומרים, "זמן" בקידוש, כיון שעושין אותו מחמת הספק שהיה לאבותינו (בזמן שהיו מקדשין על פי הראיה), שמא היום קודש ואתמול חול, אם כן לא נפטר בזמן של אתמול.

אבל בליל שני של ראש השנה, יש אומרים שאין אומרים "זמן".

כיון ששני הימים הן קדושה אחת, וכיום אחד הן חשובין, א"כ נפטר בזמן של אתמול, שהוא תחילת קדושת היום, ולמה יחזור לומר זמן באמצע.

וכן ביום שני על השופר, אין לומר זמן, שכבר נפטר בזמן שאמר אתמול על השופר.

אבל יש אומרים, שצריך לומר זמן בין בקידוש ליל שני בין על השופר, משום שמה שהן נחשבין כיום אחד ארוך אינו אלא מחמת מנהג אבותינו, שהיו בזמן קידוש החודש על פי הראיה, והיו חוששין שמא באו עדים אחר המנחה, ונמצא ששני הימים הן יו"ט אחד וקדושה אחת עליהם.

וכיון שאבותינו היו מברכין זמן ביום שני אף שהיו עושין אותן קדושה אחת וכיום אחד, שהרי אם באו עדים אחר המנחה עיקר היו"ט של תורה הוא למחר, ויום ראשון אינו אלא מדברי סופרים וכחול הוא חשוב לגבי יום שני שבו הוקבע החודש.

לפיכך גם לנו יש לברך זמן בליל שני (אף בארץ ישראל) כמו שמברכין בכל יו"ט שני של גליות, כדי שלא לשנות ממנהג אבותינו:

 

ו והלכה כסברא האחרונה.

מכל מקום לכתחלה טוב שיוציא אדם את עצמו מידי ספק ברכה, וילבוש מלבוש חדש, בענין שצריך לברך עליו שהחיינו בשעת הלבישה. כמ"ש בסי' רכ"ג.

או יקח פרי חדש, ויניחנו לפניו בעת הקידוש, ויברך שהחיינו, ויהא דעתו גם על המלבוש או על הפרי.

ואם יש לו תירוש חדש, לא יקדש עליו, כדי לברך עליו שהחיינו.

דמצוה מן המובחר לקדש על יין ישן. כמ"ש בסי' רע"ב.

אלא יקדש על הישן, ויניח התירוש לפניו, וכשיגיע לשהחיינו, יקח הכוס של תירוש בידו או יתן עיניו בו, ויברך שהחיינו וישתה הכוס של יין ישן.

ואם אין לו בגד חדש ופרי חדש, עם כל זה יברך שהחיינו שהעיקר כסברא האחרונה:[2]

 

ז וכן בתקיעת שופר של יום שני.

לכתחלה ילבש התוקע בגד חדש, ויהיה עליו בשעת ברכת שהחיינו.

(ומנהג ספרד שלא לברך שהחיינו).

ואם חל יום ראשון בשבת שלא תקעו בשופר, אינו צריך ללבוש בגד חדש בשעת תקיעות יום שני, כיון שלא בירך עדיין שהחיינו על השופר:

1. Even the people of Eretz Yisroel observe two days of Rosh Hashanah.

This is because, regarding the other festivals, the reason they observe only one day is that we are proficient in the calculation of the months, and we know which day is appropriate to establish the month and to count the festivals from it.

And even those in the Diaspora do not observe two days except to maintain the custom of their ancestors, who observed two days.

In the time when the months were sanctified based on the sighting of the moon, and the matter did not depend on calculation at all, but on the sighting of the new moon, those in the Diaspora did not know which day the month had been established in Yerushalayim, and so they would observe two days out of doubt.

But the people of Eretz Yisroel who lived near Yerushalayim would observe the festivals for only one day, because the Beis Din in Yerushalayim would send messengers to inform them of the day on which the month was established in Nissan (and Sivan) and Tishrei.

And in all the nearby places where the messengers would arrive before Yom Tov, they would observe only one day.

Therefore, even their descendants now do not need to observe two days, since we are proficient in the calculation and know which day is appropriate to establish the month and to count from it.

But this reason applies only to the other festivals, except for Rosh Hashanah.

However, on Rosh Hashanah, even the people of Eretz Yisroel must maintain the custom of their ancestors, who observed two days in the time when the months were sanctified by sighting, since the matter did not depend on knowledge of the calculation, but on the establishment of the Beis Din in Yerushalayim based on the sighting (of the witnesses of) the new moon.

And even though the Beis Din would send messengers to inform everyone, nevertheless, on Rosh Hashanah, which is Yom Tov, the messengers could not go beyond the techum.

2. And even in the Diaspora, Rosh Hashanah is different from the other festivals.

For the other festivals, even their ancestors did not observe two days except because of doubt, since they did not know which day the month had been established in Eretz Yisroel.

And an egg that was laid on the first day is permitted on the second day, for if today is holy, tomorrow is a weekday, and there is no prohibition of muktzeh or nolad. And if tomorrow is holy, today is a weekday, and the egg was already prepared from before Yom Tov.

Therefore, even their descendants, who know the fixing of the month and know that the first day is the main Yom Tov, and the second day is also Yom Tov by rabbinic decree, nevertheless, the law of this egg is not like the law of an egg laid on two adjacent days of Yom Tov, such as Shabbos and Yom Tov, where if it was laid on one it is forbidden on the other, as stated in Siman 513.

For since they observe two days only because of the custom of their ancestors, there is no need to be stricter than their ancestors, for whom it was permitted for the reason explained.

3. But regarding the two days of Rosh Hashanah, it is not so; rather, they are considered as one long day and are a single sanctity, even for the people of Eretz Yisroel.

And an egg that was laid on the first day, or something detached from what was attached on the first day, or something trapped on the first day, just as it is forbidden on that day because of muktzeh and nolad, so too it is forbidden on the second day, since they are like one long day.

Except regarding a corpse on the second day, as stated in Siman 526.

4. And why are they considered as one day, when we are proficient in the fixing of the month and know that the first day is the main one?

Because even the Beis Din themselves, who sanctified based on sighting, would sometimes observe two days.

How so?

Originally, when the thirtieth day of Elul arrived, all of Yisroel and the Beis Din would observe the prohibition of work and the sanctity of the day from the evening, for perhaps witnesses would come the next day and say they saw the new moon that night, and that day would be Rosh Chodesh Tishrei, which is Rosh Hashanah, and it would turn out that the night was Yom Tov.

And during the day, the Beis Din would sit and wait for the arrival of witnesses who saw the new moon, in case they would come. At any time during the day, until nightfall, if they came, they would sanctify the month that day, and Rosh Hashanah would be on that day. And from that day onward, they would count for Yom Kippur and Sukkos.

And the witnesses would usually come before the time of Minchah, which is the time of offering the afternoon Tamid.

Once, the witnesses were delayed and did not come until after Minchah, and the Tamid was already offered, and the Leviim erred in the song, and sang the weekday song, thinking that the witnesses would not come that day. When they did come, it turned out that the day was retroactively holy.

From that day onward, the sages decreed that the Beis Din would not accept witnesses except until Minchah. If they came after Minchah, that day would be counted as the last day of the previous month, to count that day as the thirtieth of Elul, and to count Yom Kippur and Sukkos from the next day. The Beis Din has the authority to do this, as it is written, "These are the festivals of Hashem, which you shall proclaim them"—"them" is written without a vav, meaning "you," even if you act intentionally.

Nevertheless, even though the festivals are not counted from that day, and it is considered like a weekday, and Yom Tov is the next day, they would not treat it lightly, but would complete it with its prohibition and the sanctity of Yom Tov until nightfall by rabbinic decree, since by law it was fit to be Yom Tov by Torah law, except that permission was given to the Beis Din to postpone it.

And the next day they would observe Yom Tov, which is Rosh Hashanah by Torah law.

And these two days are one sanctity, like one long day, and both are called Yom Tov of Rosh Hashanah—the first day by rabbinic decree, and the second day by Torah law.

And the places outside the techum of Yerushalayim were required to observe two days of Rosh Hashanah every year, for perhaps witnesses would come after Minchah. Thus, both days are holy and considered as one day, for they have one sanctity, which is the sanctity of Rosh Hashanah.

An Egg Laid on Rosh Hashanah and the Order of Kiddush

1. After Yom Tov, when the messengers would go out, they would inform all the people of Eretz Yisroel of the day on which the month had been established, and everyone would count from that day for Yom Kippur and Sukkos.

2. This practice continued until the Sanhedrin was abolished and the sanctification of the month by testimony ceased, and they began to establish the months according to calculation.

3. Therefore, everyone counts from the first day of Rosh Hashanah for Yom Kippur and Sukkos, since according to the calculation, Elul is always deficient.

4. Nevertheless, they must maintain the custom of their ancestors, who, in the time when the month was sanctified by testimony, would observe two days of Yom Tov for Rosh Hashanah even in Eretz Yisroel, and would treat it as one long day, with a single sanctity for both days.

5. And an egg that was laid on one of these days is forbidden on the other, for the reason explained, that perhaps witnesses arrived after the afternoon offering.

6. Therefore, even though this reason does not apply in the time when the months are established by calculation, the first day is always the primary one, and it is the Yom Tov of the Torah.

7. Nevertheless, one should not treat the second day lightly or be lenient with it in ways that our ancestors were not lenient.

8. Although on every second day of Yom Tov in the Diaspora, "Shehechiyanu" is recited in Kiddush, since it is observed due to the doubt that existed for our ancestors (in the time when the month was sanctified by testimony), that perhaps today is holy and yesterday was ordinary, and thus one was not exempted by yesterday's recitation, on the second night of Rosh Hashanah, there are those who say that "Shehechiyanu" is not recited.

9. Since the two days are one sanctity and are considered as one long day, one has already fulfilled the obligation with the recitation on the first night, which is the beginning of the sanctity of the day, so why should one recite "Shehechiyanu" again in the middle?

10. Similarly, on the second day regarding the shofar, "Shehechiyanu" should not be recited, since one has already fulfilled the obligation with the blessing recited on the shofar the previous day.

11. However, there are those who say that one must recite "Shehechiyanu" both at Kiddush on the second night and on the shofar, because the fact that the two days are considered as one long day is only due to the custom of our ancestors, who, in the time when the month was sanctified by testimony, were concerned that perhaps witnesses arrived after the afternoon offering, and thus both days are one Yom Tov and have one sanctity.

12. And since our ancestors would recite "Shehechiyanu" on the second day even though they treated both days as one sanctity and as one day, for if witnesses arrived after the afternoon offering, the main Yom Tov of the Torah would be the next day, and the first day would only be by rabbinic decree and considered like a weekday relative to the second day, on which the month was established.

13. Therefore, we too should recite "Shehechiyanu" on the second night (even in Eretz Yisroel), just as we recite it on every second day of Yom Tov in the Diaspora, so as not to deviate from the custom of our ancestors.

14. The halachah follows the latter opinion. Nevertheless, it is best, at the outset, for a person to remove himself from doubt regarding the blessing, and to wear a new garment, such that he is required to recite "Shehechiyanu" at the time of wearing it, as stated in Siman 223.

15. Or he should take a new fruit and place it before him at the time of Kiddush, and recite "Shehechiyanu," having in mind both the garment and the fruit.

16. If he has new wine, he should not recite Kiddush over it in order to recite "Shehechiyanu" on it, for the preferred mitzvah is to recite Kiddush over old wine, as stated in Siman 272.

17. Rather, he should recite Kiddush over the old wine and place the new wine before him, and when he reaches "Shehechiyanu," he should take the cup of new wine in his hand or look at it, recite "Shehechiyanu," and drink the cup of old wine.

18. If he does not have a new garment or a new fruit, nevertheless, he should recite "Shehechiyanu," for the main halachah follows the latter opinion.

19. The same applies to the shofar blowing on the second day: ideally, the one blowing should wear a new garment, and have it on at the time of the "Shehechiyanu" blessing. (The custom among Sephardim is not to recite "Shehechiyanu.")

20. If the first day falls on Shabbos, when the shofar is not blown, it is not necessary to wear a new garment at the time of the shofar blowing on the second day, since "Shehechiyanu" has not yet been recited on the shofar.
