Adopting a Child and Halachic Concerns in Modern Times

ב"ה, כ"ח שבט, תשכ"ד ברוקלין
The Rebbe addresses the halachic issues of adopting a child today, noting that efforts to make the child feel the adoptive parents are their real parents create unavoidable halachic problems. He advises against adoption under these circumstances and suggests medical consultation for having children.

Shalom u'Vrachah!

In response to your letter from the 16th of Shevat regarding the question of adopting a child, etc. Since the current approach to adoption is to do everything possible to make the child comfortable—including making him feel that these are his true natural parents—I do not see, even after safeguarding other matters such as avoiding issues of seclusion (yichud), closeness, kissing, etc. [even if the child knows these are adoptive parents; all the more so as is now customary to hide this from the child], how it is possible. These are definite rabbinic prohibitions and, according to some authorities, even Torah prohibitions. As stated above, this is all even after safeguarding other matters such as the child's origin and his kashrus, etc.

Therefore, as stated above, I do not see any possibility to help someone in such a situation; on the contrary, one should refrain from it altogether. Certainly there is no need for further elaboration on this.

Although you did not mention this, I assume you have consulted with a specialist doctor in this field regarding having children—especially since in recent years new treatments have been discovered in this area. May it be G‑d's will that you will be able to report good news in all of the above.

At an auspicious time you will be mentioned at the holy resting place of my revered father-in-law, the Rebbe zatzal (may his merit protect us), for the fulfillment of your heart's desire for good.

It is proper that you check your tefillin and also the mezuzos in your home to ensure they are all kosher according to halachah. Your wife should also maintain the good custom of Jewish women to give charity before lighting candles on Erev Shabbat and Erev Yom Tov.

Summary

The Rebbe writes that modern adoption practices pose unavoidable halachic issues and advises against adopting under such circumstances. Instead, he encourages seeking medical advice about having children and maintaining mitzvah observance at home.
