המצווה הקל"ו
הציווי שנצטווינו לקדש את שנת החמשים, כלומר: להשבית בה עבודת האדמה כמו בשמטה.
והוא אמרו יתעלה: "וקדשתם את שנת החמשים שנה" (ויקרא כה, י).
ובפרוש אמרו: "כשם שנאמר בשביעית, כך נאמר ביובל".
כלומר: השווה ביניהם בעשה, כשם שהשווה הכתוב ביניהם בלאו, כמו שאבאר.
ודיני שנת יובל ושנת שמיטה בהשבתת עבודת האדמה והפקרת כל הצומח - שווים.
ואת שני הדברים האלה כולל אמרו: "וקדשתם את שנת החמשים שנה".
וכבר ביאר הכתוב, שעניין הקדושה בהן, שיהו פירותיהן ותבואתן הפקר.
ואמר: "כי יובל היא קודש תהיה לכם מן השדה תאכלו את תבואתה" (ויקרא כה, יב).
יובל זה אינו נוהג אלא בארץ, ובתנאי שיהא כל שבט ושבט יושב במקומו, כלומר: בחלק שלו מארץ ישראל, ולא יהיו מערבין זה בזה.
The 136th Mitzvah
1. The commandment with which we were commanded to sanctify the fiftieth year, meaning: to cease agricultural work in it, just as in the Shemittah year.
2. This is as He, may He be exalted, said: "And you shall sanctify the fiftieth year" (Vayikra 25:10).
3. And explicitly they said: "Just as it is stated regarding the seventh year, so it is stated regarding Yovel."
4. That is, He equated them in a positive commandment, just as the Torah equated them in a prohibition, as I will explain.
5. The laws of the Yovel year and the Shemittah year, regarding the cessation of agricultural work and the rendering ownerless of all that grows, are the same.
6. Both of these matters are included in His statement: "And you shall sanctify the fiftieth year."
7. And the Torah has already explained that the matter of sanctity in them is that their produce and crops are ownerless.
8. And it says: "For it is Yovel, it shall be holy to you; from the field you may eat its produce" (Vayikra 25:12).
9. This Yovel applies only in Eretz Yisroel, and only on the condition that each and every tribe dwells in its place, that is, in its portion of Eretz Yisroel, and they are not intermixed with one another.
