The 292nd Mitzvah
1. The prohibition by which we were warned against killing a sinner, when we see that he has already committed a transgression for which he is liable to death, before he comes to beis din. Rather, we must bring him to beis din and bring witnesses against him before them; we are to be witnesses only, and they will judge him according to what he is liable.
2. The prohibition stated on this matter is His statement, may He be exalted: "ולא ימות הרצח עד עמדו לפני העדה למשפט" ("The killer shall not die until he stands before the assembly for judgment," Bamidbar 35:12).
3. In the words of the Mechilta: "יכול יהרגו אותו משהרג או משנאף? - תלמוד לומר: ולא ימות הרצח עד עמדו" ("One might think they may kill him as soon as he has killed or committed adultery; therefore the Torah says, 'The killer shall not die until he stands,'" Mechilta).
4. Even if it was the Great Beis Din itself that saw him kill, they all become witnesses and testify before another beis din, and the other beis din executes him.
- תלמוד לומר: ולא ימות הרצח עד עמדו לפני העדה למשפט" ("If a court (edah) saw someone kill a person, one might think they may kill him before he stands before beis din; therefore the Torah says, 'The killer shall not die until he stands before the assembly for judgment'").
