Negative Mitzvah 247 - Not to withhold payment of debts that we owe

The 247th Mitzvah

1. The prohibition in which we were warned against holding on to debts that are fixed upon us—keeping them back and not paying them.

2. This is as He, may He be exalted, said: "לא תעשק את רעך ולא תגזל" ("You shall not withhold what is due your fellow, nor rob him," Vayikra 19:13).

3. That is: stealing is taking another's property by stealth and in secret, and we were warned against this act by His words "לא תגנבו" ("You shall not steal," Vayikra 19:11), as we have explained.

4. Robbery is taking another's property by force and openly, as highwaymen do, and we were warned against this act too, by His words "לא תגזל" ("You shall not rob").

5. Withholding (oshek) is when another person has a specific debt with you—that is, money has become fixed for him with you and under your responsibility—and you hold on to it and do not hand it over to him, whether by force, or not by force but by putting him off again and again, or by deceit. We were warned against this act as well, by His words, may He be exalted: "לא תעשק את רעך" ("You shall not withhold what is due your fellow").

6. The Sifra says explicitly: "'לא תעשק'—withholding that concerns money. Which is it? This is one who withholds the wages of a hired worker." And so too anything similar to it.

7. The Torah gave the example of a hired worker's wages because it is a debt fixed upon you: even though the worker did not hand you any money of his own, and no money of his ever came into your hands, nevertheless, since a debt to him has become fixed with you, you are warned against holding on to it.

8. The prohibition is repeated on this matter, citing this very case as its example: "לא תעשק שכיר" ("You shall not withhold the wages of a hired worker," Devarim 24:14). Its meaning: do not withhold from the hired worker, because he is poor and needy, as it says of him: "ולא תבוא עליו השמש כי עני הוא" ("and the sun shall not set upon it, for he is poor," Devarim 24:15).

9. The words of the Sifri: "'לא תעשק שכיר עני ואביון' ('You shall not withhold the wages of a poor and needy hired worker')—but has it not already been said, 'לא תגזל'? This teaches that whoever withholds a hired worker's wages transgresses 'You shall not withhold,' 'You shall not rob,' 'The wages of a hired worker shall not remain with you overnight,' and 'On his day you shall give him his wages.'"

10. And there they said, explaining the words "עני ואביון" ("poor and needy"): "I am quick to exact punishment on behalf of the poor and needy."

11. One who transgresses the prohibition of withholding is punished in the same way as a robber. He, may He be exalted, said: "וכחש בעמיתו בפקדון או בתשומת יד או בגזל או עשק את עמיתו" ("and he denies to his fellow regarding a deposit, or a loan, or a robbery, or he has withheld from his fellow," Vayikra 5:21).
