המצווה הרמ"ג
האזהרה שהזהרנו מלגנוב אדם מישראל.
והוא אמרו בעשרת הדברות: "לא תגנב" (שמות כ, יג)
ולשון המכילתא: "הרי אזהרה לגונב נפש".
ובגמרא סנהדרין: "אזהרה לגונב נפשות מנין?
ר' יאשיה אומר: מ'לא-תגנב', ר' יוחנן אומר: מ'לא ימכרו ממכרת עבד' (ויקרא כה, מב).
ולא פליגי: מר קא חשב לאו דגנבה, ומר קא חשב לאו דמכירה".
לפי שאין עונשים אותו על כך עד שיגנוב וימכור, וכשיעבור על שני לאווין אלו - חייב חנק.
אמר יתעלה: "וגנב איש ומכרו ונמצא בידו מות יומת" (שמות כא, טז).
וכבר נתבארו דיני מצווה זו בפי"א מסנהדרין.
The 243rd Mitzvah
1. The prohibition in which we were warned against kidnapping a person from among the Jewish people.
2. This is His statement in the Ten Commandments: "You shall not steal" (Shemos 20:13).
3. The language of the Mechilta: "Here is a prohibition against kidnapping a person."
4. And in the Gemara Sanhedrin: "From where is there a prohibition against kidnapping people? Rabbi Yoshiya says: from 'You shall not steal.' Rabbi Yochanan says: from 'They shall not be sold as slaves' (Vayikra 25:42)."
5. And they do not disagree: one is counting the prohibition of stealing, and one is counting the prohibition of selling."
6. For one is not punished for this until he both kidnaps and sells, and when he transgresses both of these prohibitions, he is liable to strangulation.
7. The Exalted One said: "And one who kidnaps a man and sells him, and he is found in his hand, shall surely be put to death" (Shemos 21:16).
