Mitzvah 247 - To Save the Pursued from the Pursuer, Even by Taking the Pursuer's Life

The 247th Mitzvah

1. The commandment by which we were commanded to rescue the pursued from the hand of one who pursues him to kill him, even at the cost of the pursuer's life.

2. That is: we are commanded to kill the pursuer if we cannot rescue the pursued except by taking the pursuer's life.

3. This is His statement, may He be exalted: "וקצתה את כפה לא תחוס עינך" ("You shall cut off her hand; your eye shall not pity," Devarim 25:12).

4. In the words of the Sifri: "'במבושיו' - מה מבושיו מיוחד שיש בו סכנת נפשות, והרי הוא ב'וקצתה', כך כל דבר שיש בו סכנת נפשות, הרי הוא ב'וקצותה את כפה'" ("'By his private parts'—just as [seizing] his private parts is distinctive in that it endangers life, and it falls under 'you shall cut off,' so anything that endangers life falls under 'you shall cut off her hand,'" Sifri).

5. "'וקצותה את כפה' - מלמד שאתה חייב להצילו בכפה" ("'You shall cut off her hand'—this teaches that you are obligated to rescue him at the cost of her hand").

("From where do we know that if you cannot rescue him at the cost of her hand, you must rescue him at the cost of her life?")

7. "תלמוד לומר: 'לא תחוס עינך'" ("The Torah therefore says: 'Your eye shall not pity'").

8. Thus the matter of this commandment has been explained to you.

9. And as for what it says, "אשת האחד" ("the wife of one of them," Devarim 25:11), the Torah speaks only of the usual case,

10. and the intent is to rescue the pursued through the limbs of the pursuer.

11. If it is impossible to rescue him except by killing the pursuer outright, we kill him.

12. The laws of this mitzvah have already been explained in the eighth chapter of Sanhedrin.
