Mitzvah 236 - The Laws of One Who Injures Another

The 236th Mitzvah

1. The commandment in which we were commanded concerning the law of one who injures his fellow.

2. This is as He, may He be exalted, said: "וכי יריבן אנשים והכה איש את רעהו" ("And if men quarrel and one strikes his fellow," Shemos 21:18). These are what are called the laws of fines (dinei kenasos).

3. There is a verse that encompasses all the laws of fines, namely His words, may He be exalted: "כאשר עשה כן יעשה לו" ("as he has done, so shall be done to him," Vayikra 24:19).

4. The meaning is that we take from his money according to the damage he caused his fellow, as received by tradition. Even if he only humiliated him, the court collects from his money according to that damage.

5. Know that all these laws of fines—damages caused by one person to another, and likewise if an animal damaged a person or another animal—may be judged and ruled on only by a court of ordained judges (semuchin) in Eretz Yisrael.

6. The laws of this matter have already been explained in the eighth chapter of Bava Kamma.
