Mitzvah 194 - To Return Stolen Property If It Exists or With an Added Fifth; or to Pay Its Value

The 194th Mitzvah

1. The commandment in which we were commanded to return the stolen object itself, if it still exists as it was, together with an added fifth; or to pay its value if it has changed. This is as He, may He be exalted, said: "והשיב את הגזלה אשר גזל וגו'" ("he shall return the stolen object that he stole…," Vayikra 5:23).

2. It has already been explained in Tractate Makkos that the prohibition against robbery is a prohibition that is rectified by a positive commandment. They said: "For the Merciful One said: 'לא תגזל' ('You shall not rob,' Vayikra 19:13), and 'והשיב את הגזלה' ('he shall return the stolen object')…"

3. The laws of this mitzvah have already been explained in the last chapters of Bava Kamma.
