המצווה הקל"ד
הציווי שנצטווינו להפקיר כל מה שהצמיחה האדמה בשנת השמטה, ולהתיר כל צמחי שדותינו לכל.
והוא אמרו יתעלה: "והשביעית תשמטנה ונטשתה וגו'" (שמות כג, יא).
ולשון המכילתא: "והלא הכרם והזית בכלל היה ולמה יצא? להקיש אליו: מה כרם מיוחד שהוא בעשה, עוברין עליו בלא תעשה, כך כל שהוא בעשה עוברין עליו בלא תעשה".
ועניין דבר זה כמו שאסביר לך: שאמרו: "והשביעית תשמטנה ונטשתה" כולל התרת כל הצומח בשנה בשביעית: ענבים ותאנים ואפרסקים ורימונים וחיטים ושעורים וזולתם. יוצא, שהשמטת הכל - מצוות עשה.
אחר כך פרט ואמר: "כן תעשה לכרמך לזיתך". והרי אלו הם בכלל כל מה שצומח מן האדמה?
אלא לא בא הציווי הזה בכרם וזית במיוחד, אלא מפני שהזהיר בהם הכתוב במיוחד על אסיפת תבואת הכרם והוא אמרו: "ואת ענבי נזירך לא תבצר" (ויקרא כה, ה).
הנה כמו הכרם שהפקרתו - מצוות עשה, מניעתו לא תעשה, כך כל מה שתצמיח שנה שביעית שנתבאר שהפקרתו בעשה - תהיה מניעתו בלא תעשה.
אם כן יהיה דין הזית כדין הכרם בעשה ולא תעשה, ודין זית ודין שאר פרות שווה.
הנה נתבאר מכל מה שקדם, שהשמטת גדולי שביעית מצוות עשה.
וכבר נתבארנו דיני מצווה זו במסכת שביעית.
ואינה חובה מן התורה אלא לפרות ארץ ישראל בלבד.

The meaning of this is as I will explain to you: They said, "But the seventh year you shall let it rest and lie fallow," which includes permitting all that grows in the Shemitah year: grapes, figs, peaches, pomegranates, wheat, barley, and others. It follows that declaring everything ownerless is a positive commandment.
5. Afterwards, it specifies and says: "So shall you do to your vineyard and to your olive grove." But these are included in everything that grows from the ground?

Rather, this command regarding the vineyard and olive was not given specifically for them, but because the verse warned specifically about gathering the produce of the vineyard, as it says: "You shall not harvest the aftergrowth of your harvest, and you shall not gather the grapes of your unpruned vine" (Vayikra 25:5).
7. So, just as with the vineyard, where declaring it ownerless is a positive commandment and withholding it is a prohibition, so too with everything that grows in the Shemitah year, as has been explained: declaring it ownerless is a positive commandment, and withholding it is a prohibition.
8. Therefore, the law of the olive is like the law of the vineyard, regarding both the positive commandment and the prohibition, and the law of the olive and the law of other fruits is the same.
9. It is clear from all that has preceded that declaring the produce of Shemitah ownerless is a positive commandment.
10. The laws of this commandment have already been explained in tractate Sheviis.
11. And it is an obligation by Torah law only for the fruits of Eretz Yisroel alone.
