המצווה הפ"ב
הוא הציווי שנצטווינו בעריפת פטר חמור, אם אינו רוצה לפדותו.
והוא אמרו יתעלה: "ואם לא תפדה וערפתו" (שמות לד, כ).
וכבר נתבארנו גם דיני מצווה זו במסכת בכורות.
אפשר למקשה להקשות עלי ולומר: "מדוע אתה מונה פדייתו ועריפתו כשתי מצוות, ואינך מונה אותן כמצווה אחת, ותהיה עריפתו מהלכות המצווה, כמו שביארת בכלל השביעי?"
ה' יודע ועד, שהדין היה מחייב כן, לולא מצאנו בעניין זה לשון המורה על היותן שתי מצוות.
והוא אמרם:"מצוות פדיה קודמת למצוות עריפה, ומצוות ייבום קודמת למצוות חליצה".
היינו: כמו שהיבמה עומדת או לייבום או לחליצה - והייבום מצווה כמו שהזכיר והחליצה מצווה בפני עצמה - כך פטר חמור עומד או לפדייה או לעריפה, וזו מצווה וזו מצווה כמו שאמרו.
The 82nd mitzvah
This is the commandment in which we were commanded regarding the breaking of the neck of a firstborn donkey, if one does not wish to redeem it.
This is as He, may He be exalted, said: "And if you do not redeem it, you shall break its neck" (Shemos 34:20).
The laws of this mitzvah have also been explained in Maseches Bechoros.
It is possible for someone to challenge me and say: "Why do you count its redemption and its breaking of the neck as two mitzvos, and not count them as one mitzvah, with the breaking of the neck being among the laws of the mitzvah, as you explained in the seventh principle?"
G‑d knows and is witness that the law would require this, were it not that we find in this matter a wording that indicates they are two mitzvos.
This is as they said: "The mitzvah of redemption precedes the mitzvah of breaking the neck, and the mitzvah of yibum precedes the mitzvah of chalitzah."
That is: just as the yevamah stands either for yibum or for chalitzah—and yibum is a mitzvah as mentioned, and chalitzah is a mitzvah in its own right—so too, the firstborn donkey stands either for redemption or for breaking its neck, and this is a mitzvah and this is a mitzvah, as they said.
