המצווה הרע"ב
האזהרה שהזהרנו מלהחזיק משקלות ומידות חסרים אצלנו בבתינו ואף על פי שלא נשתמש בהם במקח וממכר.
והוא אמרו יתעלה: "לא יהיה לך בכיסך אבן ואבן גדולה וקטנה" (דברים כה, יג), וכן איפה ואיפה.
ולשון גמרא בבא בתרא: "אסור לאדם שישהה מידה חסרה או יתרה בתוך ביתו ואפילו היא עביט של מימי רגלים".
ואל תחשוב שאמרו: "לא יהיה לך איפה ואיפה, ולא יהיה לך אבן ואבן" - שתי מצוות.
לפי ששני הלאווין נאמרו להשלמת דיני המצווה, כדי לכלול שני מיני המדידה שהם המשקל והמידה, כאילו אמר: "לא יהיו לך שתי מדות לא במשקל ולא במידה".
כדרך שביארנו במצוות עשה.
ואמרו: "לא יהיה לך בכיסך אבן ואבן לא יהיה לך איפה ואיפה", כמו אמרו:"לא תשיך לאחיך נשך כסף נשך אכל נשך כל דבר אשר ישך" (דברים כג, כ), שהוא לאו אחד, שכלל בו מינים רבים שדן בכולם עניין אחד עצמו.
ואין המצוות מתרבות בכפל "ולא" אם העניין אחד, כמו שהקדמנו בכלל התשיעי.
וכבר קדם לך דומה לזה במצווה המשלימה מאתים ממצוות לא תעשה, והוא אמרו: "ולא יראה לך חמץ ולא יראה לך שאר".
The prohibition against keeping deficient weights and measures in one's house, even if one does not use them
1. The prohibition in which we were warned not to keep deficient weights and measures in our homes, even if we do not use them in buying and selling.
2. This is as He, may He be exalted, said: "You shall not have in your pouch differing weights, a large and a small" (Devarim 25:13), and likewise, differing measures.
3. And the language of the Gemara in Bava Basra: "It is forbidden for a person to keep a deficient or excessive measure in his house, even if it is a chamber pot for urine."
4. Do not think that when it says, "You shall not have differing measures, you shall not have differing weights," these are two separate commandments.
5. For these two prohibitions were stated to complete the laws of the commandment, in order to include both types of measurement, which are weight and volume, as if it said: "You shall not have two types of measures, neither in weight nor in volume."
6. Just as we explained in the positive commandments.
7. And when it says, "You shall not have in your pouch differing weights, you shall not have differing measures," it is like what it says: "You shall not charge your brother interest: interest of money, interest of food, interest of anything that is lent on interest" (Devarim 23:20), which is a single prohibition that includes many types, all of which are governed by the same matter.
8. And the commandments are not multiplied by the repetition of "you shall not" if the matter is one, as we have already explained in the ninth principle.
9. And something similar to this has already come before you in the commandment that completes the two hundredth of the negative commandments, which is His statement: "No chametz shall be seen with you, and no se'or shall be seen with you."
