המצווה הקמ"ג
האזהרה שהזהרנו מלאכול מעשר שני של יצהר חוץ לירושלים.
והוא אמרו: "לא תוכל לאכל בשעריך מעשר דגנך ותירושך ויצהרך" (דברים יב, יז).
והאוכל חייב מלקות.
ובאותו תנאי שקדם במעשר דגן.
ואולי תתמה על שמנינו מעשר דגן, ומעשר תירוש, ומעשר יצהר, שלש מצוות?
דע שאם אכל שלשתן כאחד - לוקה על כל אחת ואחת.
לפי שלאו זה שבפסוק זה, אינו "לאו שבכללות", שאין לוקין עליו, אלא הוא לחלק.
ובפירוש אמרו בגמרא מכות:"אכל מעשר דגן ותירוש ויצהר - חייב על כל אחת ואחת.
וכי לוקין על לאו שבכללות?
קרא יתירא כתיב.
מכדי, כתיב: "ואכלת לפני ה' אלהיך [וגו'] מעשר דגנך תירשך ויצהרך וכו'" (שם יד, כג) ולמה לי למהדר למכתבינהו לכלהו?
שמע מינה לחלק".
ובגמרא מכות אמרו:"מכדי, כתיב: "ואכלת לפני ה' אלהיך מעשר דגנך תירשך ויצהרך".
לכתוב רחמנא: "לא תוכל לאכל אותם בשעריך" מהדר פירושנהו לכלהו למה לי?
שמע מנה ליחודיה לאו לכל חד וחד".
הרי נתבאר שכל מה שהזהיר עליו בפסוק זה, כל עניין ועניין לאו בפני עצמו.
ואחזור להשלים שאר הלאווין שכלל אותם הפסוק.
Commandment 143
The prohibition in which we were warned not to eat maaser sheni of oil outside of Yerushalayim.
This is as it is stated: "You may not eat within your gates the tithe of your grain, your wine, and your oil" (Devarim 12:17).
One who eats it is liable for lashes.
This is under the same condition that was stated regarding the grain tithe.
And you might wonder why we counted the grain tithe, the wine tithe, and the oil tithe as three separate commandments.
Know that if someone ate all three together, he would receive lashes for each one individually.
For this prohibition in this verse is not a "general prohibition," for which lashes are not given, but rather it is divided.
And it is explicitly stated in the Gemara Makkos: "If one ate the grain tithe, the wine tithe, and the oil tithe, he is liable for each one individually.
And do we give lashes for a general prohibition?
An extra verse is written.
Since it is written: 'And you shall eat before Hashem your G‑d... the tithe of your grain, your wine, and your oil...' (ibid. 14:23), why is it necessary to repeat and write them all again?
Learn from this that it is to divide them."
And in the Gemara Makkos it says: "Since it is written: 'And you shall eat before Hashem your G‑d the tithe of your grain, your wine, and your oil,' let the Torah write: 'You may not eat them within your gates.' Why does it repeat and specify each one? Learn from this that each one has its own prohibition."
Thus, it is clear that everything warned about in this verse, each matter is a separate prohibition.
And I will return to complete the rest of the prohibitions included in this verse.
