האזהרה שהזהרנו מלעשות שמן כשמן המשחה.
והוא אמרו יתעלה: "ובמתכנתו לא תעשו כמהו" (שמות ל, לב).
והעובר על לאו זה, אם הוא מזיד - חייב כרת, כמו שבא בכתוב: "איש אשר יעשה כמוה וכו' " (שמות ל, לח).
ואם הוא שוגג - חייב חטאת קבועה. וכבר נתבארו דיני מצווה זו בפרק א' מכריתות.
המצווה הפ"ג
This is Mitzvah Pei-Gimel—the eighty-third mitzvah in the Rambam's Sefer HaMitzvos.
האזהרה שהזהרנו מלעשות שמן כשמן המשחה.
The warning that we've been warned here is not to make oil in the same formula as the שמן המשחה—the anointing oil.
This oil, the שמן המשחה, was used for anointing the Mizbeach and the Kohanim. The Torah prohibits us from making oil with the same ingredients and proportions as this special anointing oil.
והוא אמרו יתעלה: "ובמתכנתו לא תעשו כמהו" (שמות ל, לב).
The source for this prohibition is the verse where Hashem says: ובמתכנתו לא תעשו כמהו—"In its formula, you shall not make like it." This is from Shemos, chapter 30, verse 32.
The Torah is very clear: do not replicate the formula of the anointing oil for your own use.
והעובר על לאו זה, אם הוא מזיד - חייב כרת, כמו שבא בכתוב: "איש אשר יעשה כמוה וכו' " (שמות ל, לח).
If someone violates this prohibition and makes oil like the anointing oil, the Torah distinguishes between different levels of intent. If he did it intentionally—if he was a מזיד—then he is liable for kares, spiritual excision.
This is as the verse says: "A person who makes like it..."—meaning, if you deliberately make oil in this formula, the penalty is kares, being cut off from the Jewish people.
ואם הוא שוגג - חייב חטאת קבועה. וכבר נתבארו דיני מצווה זו בפרק א' מכריתות.
If, however, he did it by accident—if it was שוגג—then he is obligated to bring a korban chatas kevuah, a fixed sin offering.
