הציווי שנצטווינו לעשות הכר במצורע כדי שיפרשו ממנו.

והוא אמרו יתעלה: "והצרוע אשר בו הנגע - בגדיו יהיו פרומים וראשו יהיה פרוע ועל שפם יעטה וטמא טמא יקרא" (שם יג, מה).

והראיה שזוהי מצוות עשה - היא אמרם בספרא: "לפי שנאמר ראשו לא יפרע ובגדיו לא יפרום (שם כג, י), יכול אף על פי [שהוא] מנגע? ומה אני מקים: "בגדיו יהיו פרומים וראשו יהיה פרוע" בכל אדם חוץ מכהן גדול, תלמוד לומר: "אשר בו הנגע" - אף כהן גדול יהיו בגדיו פרומים, קרועים, וראשו יהיה פרוע, יגדל פרע".

ברור אם כן, שפרימה או פריעה של כהן גדול בלא תעשה, והכלל הוא אצלנו: 'כל מקום שאתה מוצא עשה ולא תעשה, אם אתה יכול לקיים את שניהם מוטב; ואם לאו יבוא עשה וידחה את לא תעשה'.

וכיון שמצאנו שהם אומרים, כי כהן גדול אם נצטרע פורע ופורם, הרי ראיה שזו מצוות עשה.

וכבר נמסר לנו בקבלה, שגם שאר טמאים צריכים לעשות לעצמם הכר, כדי שיפרשו בני אדם מהם.

ולשון ספרא: "טמא מת ובועל נידה וכל המטמאין את האדם מנין? תלמוד לומר: וטמא טמא יקרא". עניינו: כל טמא צריך להכריז על עצמו שהוא טמא, והוא: שישים לעצמו הכר המראה שהוא טמא ושהנוגע בו נטמא, כדי שיבדלו ממנו.

וכבר נתבאר שהכר זה של מצורע אינו חובה לנשים כלל, והוא אמרם: "האיש פורע ופורם ואין האשה פורעת ופורמת", אבל עוטה על שפם ומודיעה על עצמה כשאר הטמאים.

The 112th Mitzvah

1. The commandment with which we were commanded to make a sign for a metzora so that people will keep away from him.

2. This is as He, may He be exalted, said: “And the metzora who has the affliction—his garments shall be torn, his head shall be unshorn, and he shall cover his upper lip, and he shall call out: ‘Impure, impure!’” (Vayikra 13:45).

3. The proof that this is a positive commandment is their statement in the Sifra: “Since it is said, ‘He shall not let his hair grow long and he shall not rend his garments’ (Vayikra 21:10), could it be even if he is afflicted? How then do I establish, ‘His garments shall be torn and his head shall be unshorn’? For everyone except the Kohen Gadol. The verse therefore says, ‘who has the affliction’—even the Kohen Gadol must have his garments torn and his head unshorn, letting his hair grow long.”

4. It is therefore clear that tearing or letting the hair grow long for the Kohen Gadol is a prohibition, and the rule among us is: “Whenever you find a positive commandment and a prohibition, if you can fulfill both, it is preferable; but if not, the positive commandment overrides the prohibition.”

5. And since we find that they say that if the Kohen Gadol becomes a metzora, he lets his hair grow and tears his garments, this is proof that this is a positive commandment.

6. And it has already been handed down to us by tradition that other people who are impure must also make a sign for themselves so that others will keep away from them.

7. And the language of the Sifra: “From where do we know about one who is impure from a corpse, one who has relations with a niddah, and all those who render a person impure? The verse says: ‘And he shall call out: Impure, impure.’” Its meaning is: every impure person must announce about himself that he is impure, that is, he must make for himself a sign that shows he is impure and that whoever touches him becomes impure, so that people will separate from him.

8. And it has already been explained that this sign for a metzora is not obligatory for women at all, as they said: “A man lets his hair grow and tears his garments, but a woman does not let her hair grow or tear her garments.” However, she does cover her upper lip and makes it known about herself like other impure people.
