Mitzvah 96 - The Laws of Ritual Impurity from a Carcass

המצווה הצ"ו

הציווי שנצטווינו בטומאת הנבלה.

ומצווה זו כוללת טומאת נבלה וכל דיניה.

והנני מזכיר לך עתה הקדמה, אשר ראוי שתזכרנה בכל מה שיזכר לקמן ממיני הטמאות, והוא:

זה שאנו מונים כל מין ומין מן הטמאות כמצוות עשה, אין עניינו שאנו חייבים להיטמא בטמאה זו, וגם לא שאנו מזהרים מלהיטמא בה, עד שיהיו מצוות לא תעשה.

אלא זה שהתורה אמרה כי הנוגע במין זה נטמא, או שדבר זה מטמא באופן כזה, למי שנגע בו - מצוות עשה. כלומר: דין זה שנצטווינו בו הוא מצווה.

היינו שאנו אומרים, שהנוגע בדבר פלוני באופן כזה נטמא; ואם הוא במצב אחר, אינו נטמא.

אך עצם ההטמאות הוא דבר של רשות: אם רוצה מטמא ואם לאו אינו מטמא.

ולשון ספרא:"'ובנבלתם לא תגעו' (ויקרא יא, ח).

יכול אם נגע אדם בנבלה ילקה ארבעים?

תלמוד לומר: 'ולאלה תטמאו' (שם יא, כד).

יכול אם ראה אדם נבלה ילך ויטמא לה?

תלמוד לומר: 'ובנבלתם לא תגעו'.

הא כיצד?

הווי אומר: רשות".

אם כן המצווה היא הדין אשר נצטווינו בדינים אלו, ונאמר לנו, שהנוגע בזה נטמא ונעשה טמא, וחייב בכל חיובי הטמאים:

לצאת חוץ למחנה שכינה.

ושלא לאכול קודש.

ולא לנגע בו, וכיוצא בזה.

וזהו הציווי.

כלומר: שנעשה טמא אם נגע בדבר זה, או אם היה בקרבתו באופן מסוים.

וזכור עניין זה בכל מין ממיני הטמאה.

The 96th Mitzvah

The commandment in which we were commanded regarding the impurity of a carcass.

This mitzvah includes the impurity of a carcass and all its laws.

Now, I will remind you of a principle that you should remember regarding everything that will be mentioned below about the types of impurities, and it is as follows:

The fact that we count each type of impurity as a positive commandment does not mean that we are obligated to become impure with that impurity, nor does it mean that we are warned to avoid becoming impure by it, so that they would be negative commandments.

Rather, when the Torah says that one who touches this type becomes impure, or that this thing imparts impurity in such a manner to one who touches it—this is a positive commandment. That is, this law that we were commanded about is itself a mitzvah.

Meaning, we say that one who touches a certain thing in a certain way becomes impure; and if he is in a different situation, he does not become impure.

But the actual becoming impure is optional: if one wishes, he may become impure, and if not, he does not become impure.

The language of the Sifra: “‘And you shall not touch their carcass’ (Vayikra 11:8). Could it be that if a person touches a carcass, he receives forty lashes? The verse says: ‘And for these you shall become impure’ (ibid. 11:24). Could it be that if a person sees a carcass, he should go and become impure by it? The verse says: ‘And you shall not touch their carcass.’ How is this? You must say: it is optional.”

Therefore, the mitzvah is the law that we were commanded in these matters, and it was told to us that one who touches this becomes impure and is rendered tamei, and is obligated in all the obligations of those who are impure:

To go outside the camp of the Shechinah,

And not to eat sacred food,

And not to touch it, and the like.

And this is the commandment:

That one becomes impure if he touches this thing, or if he is in its proximity in a certain manner.

And remember this matter regarding every type of impurity.
