במענה למכתבו מג' שבט עם המצורף אליו, הצעת חוק בהנוגע ליחסים בין יצרנים וסוכניהם.
והנה בעניני חשן משפט בכלל ובעניני כלכלה ומסחר בפרט, קובעים בזה, במדה הכי חשובה, הנוהג באותו זמן ובאותו מקום וארץ, וכמובא בכ"מ בש"ס ופוסקים, ובפרט שכפי השמועה הנוהג בענינים אלו באה"ק ת"ו הוא כבר משך עשיריות בשנים, עד אשר למרות שחלו כמה שינוים בכמה שטחים, הרי בשטח האמור נמשך המצב כמעט כמאז ומקדם, והשינוים קלים הם בערך, ולכן בודאי שבא בדברים עם הבקיאים בהאמור, ויודעים בטח גם הנמוקים והטעמים של המנהגים השונים בזה, שבזה תלוים ג"כ השינוים שאפשר לעשותם, ובסגנון חז"ל בטל טעם בטלה הגזירה.
כיון שכותב שבעבוד הצעה האמורה התענין בספרי שו"ת וכו' רצוני להסיק מזה, אשר יש לו קביעות עתים לעתים תכופות בלימוד תורתנו תורת חיים, ולא באתי אלא לעורר ע"ד ההכרח לקבוע עתים גם בלימוד תורת החסידות, אשר בתקופתנו זו בפרט ובאה"ק ת"ו ביחוד, הרי זה צו ודרישת השעה, ובודאי לדכוותי' האריכות בזה למותר.

In response to your letter from the 3rd of Shevat with its attachment—a draft law regarding the relationship between manufacturers and their agents. In matters of Choshen Mishpat in general, and especially in economic and commercial issues, the prevailing custom at that time and place is of utmost importance, as is brought in many places in the Talmud and poskim. Especially since, according to reports, this custom in these matters in Eretz HaKodesh has existed for decades; even though there have been several changes in various areas, in this particular area the situation has remained almost as it was originally, with only minor changes. Therefore, you have surely consulted with experts on this matter who certainly also know the reasons behind the various customs here—since any changes that can be made depend on these reasons as well. As our Sages say: "When the reason ceases, so does the decree."
Since you write that while working on this proposal you researched responsa literature etc., I wish to infer from this that you regularly set aside frequent times for studying our Torah of life. I only wish to emphasize the necessity of also setting fixed times for studying Chassidus—which in our era generally and particularly in Eretz HaKodesh is an imperative and a demand of the time. Surely for someone like yourself further elaboration is unnecessary.
