Not to Put on Teffilin on Chol Hamoed Even if Others Do

The Rebbe writes that one who does not put on teffilin on Chol Hamoed should maintain his custom, even if everyone else in the synagogue does put them on. There is no concern of 'Lo Tisgodedu' in this case, as there are other possible reasons for not wearing teffilin.

Regarding your question, which one of the members of your shul brought to your attention: since everyone in the shul puts on teffilin during Chol Hamoed, you should also put on teffilin. You ask my opinion about this: Answer: This question is discussed in many responsa, because it touches upon the issue of Lo Tisgodedu (do not make separate groups), which our Sages interpret as "do not make factions." Therefore, it is ruled that if someone who has the custom to put on teffilin during Chol Hamoed finds himself in a shul—during davening—where no one puts on teffilin, he should not put on teffilin. On the other hand, someone whose custom is not to put on teffilin—as is the custom of the Arizal, the Baal Shem Tov and their students—on Chol Hamoed, even if he finds himself during davening in a shul where everyone does put on teffilin, he should maintain his custom and not put on teffilin. In this case there is no concern for Lo Tisgodedu because someone seeing him not putting on teffilin can assume it is for other reasons—for example, because he already put them on earlier or because he is not yet ready to put them on (for which one needs a clean body), etc.

The above ruling can be found in the sefarim Eshel Avraham siman 31; Shu"t Menuchas Moshe siman 64; Shu"t Levush Mordechai new edition siman 123; in the sefer Maasef Lechol HaMachanos; and in Kitzur Shulchan Aruch with the commentary Shaarim Metzuyanim B'Halacha (New York print 5711) at the end of siman 10, etc.
