האזהרה שהוזהר עוד כל שבט לוי, מלקחת חלק בביזה שבוזזים בשעת כבוש ארץ ישראל.
והוא אמרו יתעלה: "לא יהיה לכהנים הלויים כל שבט לוי חלק ונחלה". (דברים יח, א)
ולשון ספרי:"חלק בבזה, ונחלה בארץ".
אפשר לך להקשות עלי ולומר, "למה מנית שני ענינים אלו שתי מצוות, והם: האזהרה מלקחת חלק בארץ, והאזהרה מלקחת חלק בבזה.
והלא הם בלאו אחד, והרי זה לאו שבכללות, שהקדמת, שהוא נמנה לאו אחד?"
דע, שכבר נתחלק לאו זה ואמר: "ונחלה לא יהיה לו" (דברים, יח, ב), והרי הם שני לאווין בשני שמות:
האחד מהם: "לא יהיה לכהנים הלויים חלק ונחלה" והוא האזהרה מלקחת חלק בביזת הארץ.
והשני: "ונחלה לא יהיה לו", האזהרה מלקחת חלק בארץ.
וכבר נכפל הלאו, על שני ענינים אלו עצמם, בכהנים.
והוא אמרו יתעלה לאהרן: "בארצם לא תנחל, וחלק לא יהיה לך בתוכם" (במדבר יח, כ).
ובא הפירוש:"בארצם לא תנחל" - בשעת חילוק הארץ.
"וחלק לא יהיה לך בתוכם" - בבזה.
ואולי תחשוב, ששני הלאווין האלה הנזכרים בכהנים, שתי מצוות, ולפיכך ראוי למנותם.
דע, שכיון שהלאו בא באופן כללי: 'כל שבט לוי', הרי נכנסו הכהנים בכלל, ואמנם כפלו בכהנים לחיזוק העניין.
וכן כל הדומה לזה מן הכלל והפרט, אינו נכפל אלא לחיזוק ולהשלמת הדין, כיון שלא הושג הדין בשלמות מן הלאו האחד.
ואילו מנינו אמרו לאהרן: "בארצם לא תנחל וחלק לא יהיה לך בתוכם" נוסף על אמרו: "לא יהיה לכהנים הלויים" וגו'.
כי אז נצטרך למנות, לפי ההיקש הזה בעצמו, איסור הגרושה והחללה והזונה על כהן גדול, שלושה לאווין, נוסף על שלושת הלאווין שבאו בכל כהן בכלל, בין גדול בין הדיוט.
ואם יאמר האומר: שכך צריך למנות.
נאמר לו: שבהכרח יהיה כהן גדול בגרושה חייב שתים:
אחת, משום שהוא כהן והגרושה אסורה לו.
והשניה, משום שהוא כהן גדול, והיא אסורה עליו עוד בלאו אחר.
וכבר נתבאר בגמרא קדושין, שאינו חייב אלא אחת.
נמצא, שהלאו הכללי בלבד הוא שנמנה, וכל לאו אחר שיבוא באותו עניין בפרטות, אינו אלא ללמד איזה דין, או להשלמת העניין.
כדרך שביארנו במצווה קס"א ממצוות אלו.
ומן הסוג הזה בעצמו, האזהרה שהזהיר את הכהנים ש"לא יקרחו קרחה בראשם, ופאת זקנם לא יגלחו, ובבשרם לא ישרטו שרטת ".(ויקרא כא, ה).
ושלושה לאווין אלו בעצמם, כבר קדמו לכל ישראל בכלל.
ואמר: "לא תקפו פאת ראשכם ולא תשחית" (ויקרא יט, כז).
"ולא תשימו קרחה בין עיניכם למת" (דברים יד, א).
"ושרט לנפש לא תתנו בבשרכם" (ויקרא יט, כח).
ונכפלו בכהנים להשלמת הדין בלבד.
כמו שנתבאר בסוף מכות, כשנתבארו דיני שלוש המצוות האלה.
ואילו היו לאווין מיוחדים בכהנים, ולא היו להשלמת דין אלא היו מצוות נפרדות, כי אז היה הכהן חייב על כל מעשה מהם שתי מלקיות:
משום שהוא ישראלי.
ומשום שהוא כהן.
ואין הדבר כן.
אלא מלקות אחת בלבד כשאר ישראל, כמו שנתבאר במקומו.
והבן כלל זה ודעהו.
The prohibition for the tribe of Levi to take a share in the spoils during the conquest of Eretz Yisroel
1. The prohibition that the entire tribe of Levi was further warned against is taking a share in the spoils that are taken during the conquest of Eretz Yisroel.
2. This is as it is stated: "The Kohanim, the Leviim, the entire tribe of Levi, shall have no portion or inheritance" (Devarim 18:1).
3. And the language of the Sifri is: "A portion in the spoils, and an inheritance in the land."
4. You might challenge me and say: "Why did you count these two matters as two separate mitzvos—the prohibition against taking a share in the land, and the prohibition against taking a share in the spoils? Are they not included in a single prohibition, and is this not a general prohibition, which you have previously stated is counted as one?"
5. Know that this prohibition is divided, as it says: "And he shall have no inheritance" (Devarim 18:2), so they are two prohibitions with two distinct names:
6. One is: "The Kohanim, the Leviim, the entire tribe of Levi, shall have no portion or inheritance," which is the prohibition against taking a share in the spoils of the land.
7. The second is: "And he shall have no inheritance," which is the prohibition against taking a share in the land itself.
8. This prohibition was also repeated regarding the Kohanim themselves, as it says to Aharon: "You shall have no inheritance in their land, and you shall have no portion among them" (Bamidbar 18:20).
9. And the explanation is: "You shall have no inheritance in their land"—at the time of the division of the land; "and you shall have no portion among them"—in the spoils.
10. You might think that these two prohibitions stated regarding the Kohanim are two mitzvos, and therefore should be counted separately.
11. Know that since the prohibition is stated in a general way—"the entire tribe of Levi"—the Kohanim are included in this, and the repetition regarding the Kohanim is only to strengthen the matter.
12. And so it is with anything similar, where a general and a specific are mentioned: the repetition is only to strengthen and complete the law, since the law was not fully derived from the general prohibition alone.
13. If we were to count the statement to Aharon, "You shall have no inheritance in their land and you shall have no portion among them," in addition to the statement, "The Kohanim, the Leviim, the entire tribe of Levi, shall have no portion or inheritance," then, by this same logic, we would have to count the prohibition for a Kohen Gadol to marry a divorcee, a chalalah, or a zonah as three separate prohibitions, in addition to the three prohibitions that apply to every Kohen, whether Kohen Gadol or ordinary Kohen.
14. And if someone says that this is indeed how it should be counted, we would respond that, by necessity, a Kohen Gadol who marries a divorcee would be liable for two prohibitions: one because he is a Kohen and a divorcee is forbidden to him, and a second because he is a Kohen Gadol and she is forbidden to him by another prohibition.
15. But it has already been clarified in the Gemara in Kiddushin that he is only liable for one.
16. Thus, only the general prohibition is counted, and any other prohibition that comes in that matter in a specific way is only to teach some law or to complete the matter, as we explained in mitzvah 161 of these mitzvos.
17. Of this same type is the prohibition that warns the Kohanim: "They shall not make a bald spot on their heads, nor shave the edge of their beard, nor make a cut in their flesh" (Vayikra 21:5).
18. And these three prohibitions themselves have already been stated previously for all of Israel in general: "You shall not round off the edge of your head, nor destroy the edge of your beard" (Vayikra 19:27); "You shall not make a bald spot between your eyes for the dead" (Devarim 14:1); "You shall not make a cut in your flesh for the dead" (Vayikra 19:28).
19. And they were repeated for the Kohanim only to complete the law, as is explained at the end of Makkos, when the laws of these three mitzvos are clarified.
20. If these were unique prohibitions for the Kohanim, and not only to complete the law but were separate mitzvos, then a Kohen would be liable for two sets of lashes for each act: one because he is a Jew, and one because he is a Kohen. But this is not the case; rather, he receives only one set of lashes, like any other Jew, as is explained in its place.
