Negative Mitzvah 297 - Not to refrain from saving a life when able

The 297th Mitzvah

1. The prohibition by which we were warned against refraining from saving the life of a fellow Jew when we see him in danger of death or destruction and we have the ability to save him.

2. For example: he is drowning in water, and we are good swimmers and can save him;

3. or a non-Jew wants to kill him, and we are able to dispel what is in his heart or to ward off his harm.

4. The warning against holding back from saving him came in His statement, may He be exalted: "לא תעמד על דם רעך" ("Do not stand by your fellow's blood," Vayikra 19:16).

5. They said that one who withholds his testimony is also included in this warning, since he sees his brother's money being lost and could restore it to him by telling the truth.

6. It is further stated on this matter: "אם לא יגיד ונשא עונו" ("If he does not tell, he shall bear his iniquity," Vayikra 5:1).

7. In the words of the Sifra: "מנין שאם אתה יודע לו עדות, שאין אתה רשאי לשתוק עליה?" ("From where do we know that if you know testimony in his favor, you are not permitted to keep silent about it?" Sifra)

8. "ת"ל: 'לא תעמד על דם רעך'" ("The Torah therefore says: 'Do not stand by your fellow's blood'").

("From where do we know that if you saw him drowning in a river, or bandits coming upon him, or a wild beast coming upon him, you are obligated to save him?")

10. "ת"ל: 'לא תעמד על דם רעך'" ("The Torah therefore says: 'Do not stand by your fellow's blood'").

("From where do we know that when one pursues his fellow to kill him, you are obligated to save [the pursued] at the cost of [the pursuer's] life?")

12. "ת"ל: 'לא תעמד על דם רעך'" ("The Torah therefore says: 'Do not stand by your fellow's blood'").

13. The laws of this mitzvah have already been explained in tractate Sanhedrin.
