On the Status of Ever HaYarden as Chutz La’aretz

במענה על מכתבו, שבו העיר במ"ש בקטע השיחה של ש"מ אלול אשר ערי מקלט היו בכל מקום שהיו יהודים, הן במדבר והן "בעבר הירדן אין חו"ל", ושואל הכוונה אם עבר הירדן וחו"ל הם שני ענינים, או שעבר הירדן הוא חו"ל.

מענה:

כשיראה בהנוסח, שהוגה על ידי, הנה כתוב שם "סאיי אין מדבר, סאיי אין ארץ ישראל, סאיי אין עבר הירדן אין חוץ לארץ", ואם הי' ענין חו"ל סוג רביעי, הי' כתוב גם בזה התיבה "סאיי".

וכוונתי היא, שעבר הירדן (לגבי ארץ ישראל) היא חו"ל. ועיין בספרי פ' מסעי, וברמב"ם הלכות רוצח רפ"ח, ובכ"מ שם שלתירוץ אחד מפרש לשון הספרי שכתוב שם חו"ל, שעבר הירדן לגבי ארץ ישראל חו"ל קרי לו.

ומה שהקשה במכ' על הספרי, למה לו לרבות מהכתוב תהיינה, ערי עבר הירדן, כיון שמפורשים הם בכתוב. י"ל ע"פ המבואר בתוספתא (פ"ב. וכ"ה גם בירושלמי כמדומני, כי אינו תח"י) דמכות, שאם חרבו ערים אלו, בונים אחרים, ואם אי אפשר במקומם אז בונים גם במקום אחר. וילפינן מתיבת תהיינה, שצריכים להיות עכ"פ בעבר הירדן...

In response to your letter, in which you commented on what is written in a section of the sicha from Shabbos Mevarchim Elul that there were cities of refuge wherever there were Jews—whether in the desert or "in Ever HaYarden there is no Chutz La’aretz"—and you ask whether Ever HaYarden and Chutz La’aretz are two separate concepts or if Ever HaYarden is itself Chutz La’aretz.

Answer: When you look at the wording, which was edited by me, it says there "sai in the desert, sai in Eretz Yisrael, sai in Ever HaYarden in Chutz La’aretz," and if Chutz La’aretz was a fourth category, it would also have used the word "sai" for it. My intention is that Ever HaYarden (in relation to Eretz Yisrael) is considered Chutz La’aretz. See Sifri Parshas Masei and Rambam Hilchos Rotzeach ch. 8, and Kesef Mishneh there who explains according to one answer that where Sifri writes Chutz La’aretz it refers to Ever HaYarden being called Chutz La’aretz relative to Eretz Yisrael.

As for your question on Sifri—why does it need to include from the verse "tehiyenah," the cities of Ever HaYarden, since they are already explicit in the verse? It can be explained based on what is clarified in Tosefta (ch. 2; so too apparently in Yerushalmi though I do not have it at hand) Makkos: if these cities were destroyed others are built; if not possible in their place then they are built elsewhere. We learn from the word "tehiyenah" that they must at least be in Ever HaYarden…
