אף על פי שזמן רב לא נתקבלה ידיעה ממנו, אעמידו על חזקתו שהשלום והבריאות אתו בגו"ר גם יחד, ובפרט על פי פס"ד של המורה הגדול הרמב"ם הל' דעות ריש פ' ד', שבריאות הגוף ושלימותו מדרכי ה' הוא, ועל אחת כמה וכמה בריאות הנשמה ועניני'. ובזה - פעולותיו בהמכון שזכה והצליח לעמוד בראשו. ואגב, אם הופיעו ספרים ופרסומים נוספים בטח לא ימנע הטוב מלשלחם לכאן כמנהגו הטוב בעבר, ות"ח מראש.

ועל של עתה:

ימים אלו נודעתי שנתמנתה על ידי שר המשפטים ועדת משפטנים שהוטל עלי' להציע סדרת חוקים אשר תחליף את החוק האזרחי, בשטח דיני חוזים, מקח וממכר, שכירות וכדומה, הקיימים כעת באה"ק ת"ו משרידי המשטרים הקודמים, ואשר בין חברי הועדה יש ג"כ ב"כ מהדתיים, העו"ד ליפשיץ, ועוד זאת אשר הרשות נתונה לחברי הועדה להתייעץ עם מי שמוצאים לנחוץ בכל הענינים הנוגעים בתחום זה.

גם נודעתי מפי מומחים במקצוע זה, כי בשטח זה של דיני חוזה, מו"מ וכו', אפשר במיוחד לתקן הרבה מחמת הבלבול והערבוב של כמה חוקים, ועוד ועיקר שההתנגדות מצד הבלתי דתיים להפעיל משפט התורה בחלק זה דחו"מ תהי' מינימלית. אלא שכמובן שצריך להוציא ולקבץ מהחו"מ את הדינים השייכים לשטח האמור ולהכניסם למסגרת הנ"ל בניסוח המתאים, כי בודאי אשר הניסוח תופס מקום וישפיע על הצלחת המפעל לבסס את החוקים האזרחיים על יסוד תורתנו תורת חיים. ומובן וגם פשוט אשר אם המפעל הנ"ל יצליח, הרי יהיו סכויים מבוססים להקל התעמולה והפעולה להעביר צעד אחר צעד גם שאר השטחים שבשיפוט באה"ק ת"ו לדיני התורה.

כיון שארגון קבוצת תלמידי חכמים שיתעסקו בהנ"ל לע"ע בנוגע שטח החוזים וכו', הוא ענין מסובך ומכמה טעמים, הן מצד עצם הדבר והן מצד הארגוני וההוצאות וכו', עלה ברעיוני שהדרך הכי קרובה להבפועל ממש (שהרי גם הזמן גרמא שלא לאחר המועד) היא שחברי המכון שבלאו הכי מתעסקים בכגון דא, ובודאי חלק מהם במיוחד בשטח האמור, הרי מביניהם אפשר לבחור מסוגלים להעבודה האמורה במיוחד. וכיון שעל פי השמועה העו"ד מר ליפשיץ איש נוח הוא וכו' ויהי' מעונין גם מנקודת הדת לגשם הנ"ל, הרי אפשר שיופתר הענין בהצלחה רבה.

ואל התעניניות כת"ר ואל בינתו אשען, ולא אאריך יותר בהאמור. ויונעם לי להוודע מתגובת כת"ר על כל האמור, ובעיקר מהפעולות להביא הדבר לידי פועל ממש, ופשוט בשמירת הנקודה אשר זאת התורה לא תהי' מוחלפת, שמירה קפדנית.

Although I have not received news from you for a long time, I assume that all is well and that you are healthy in every way, especially according to the ruling of the great teacher Rambam (Hilchos Deos, beginning of chapter 4), that bodily health and wholeness are part of the ways of G‑d—and all the more so the health and completeness of the soul and its matters. This also applies to your activities at the institute which you have merited and succeeded to head.

Incidentally, if there have been any new books or publications released, surely you will not withhold sending them here as per your good custom in the past—thank you in advance.

As for now: Recently I learned that a committee of legal experts has been appointed by the Minister of Justice to propose a series of laws to replace current civil law in Eretz Yisrael—specifically regarding contracts, sales, rentals, etc.—which are remnants from previous regimes. Among the committee members there are also representatives from religious circles, such as Attorney Lifshitz. Furthermore, committee members are permitted to consult with anyone they deem necessary on all matters related to this field.

I have also heard from experts in this area that specifically in contract law and similar areas there is much room for improvement due to confusion and overlap among several laws. Most importantly, opposition from non-religious circles to implementing Torah law in this area (Choshen Mishpat) will be minimal. Of course it is necessary to extract and compile from Choshen Mishpat those laws relevant to this field and fit them into the above framework with appropriate wording—since wording is certainly significant and will affect the success of establishing civil law on the foundation of our Torah, Toras Chaim.

It is clear and simple that if this endeavor succeeds there will be solid prospects for easing advocacy and action to gradually transfer other areas under jurisdiction in Eretz Yisrael as well to Torah law.

Since organizing a group of Torah scholars who would deal with this matter—at least regarding contracts—is complicated for several reasons (both inherent and organizational/financial), it occurred to me that the closest path to practical implementation (especially since time is pressing) is for members of your institute—who already deal with such matters—to select those particularly suited for this work.

And since it is rumored that Attorney Mr. Lifshitz is an agreeable person who would also be interested from a religious perspective in realizing this goal, it may be possible for this matter to succeed greatly.

I rely on your interest and understanding regarding this matter and will not elaborate further here.

I would be pleased to hear your response on all of the above—especially regarding actions taken toward actual implementation—and obviously with strict adherence to "this Torah shall not be replaced," maintaining careful observance.
